Terms and Conditions of this Purchase Order

This Purchase Order is issued by the Harare Provincial Education Office, Zimbabwe Harare, and constitutes a binding procurement instrument for the engagement of School Counselor services as described in the line items above. The vendor shall commence service delivery no later than 1 January 2025.
All School Counselor personnel engaged under this Purchase Order must hold valid registration with the Zimbabwe Council for Professional Teachers (ZIMCPT) and possess a minimum of a Bachelor's degree in Counselling Psychology, Educational Psychology, or a related field recognised by the Council for Higher Education in Zimbabwe.
Payment shall be made in United States Dollars (USD) via electronic funds transfer to the vendor's designated account at CBZ Bank, Harare Main Branch, within thirty (30) calendar days of receipt of a valid tax invoice and a monthly service delivery report signed by the Head of School at each institution in Zimbabwe Harare.
The vendor shall comply with all applicable laws of the Republic of Zimbabwe, including the Labour Act [Chapter 28:01], the Children's Act [Chapter 5:08], the Data Protection Act [Chapter 10:27], and the Zimbabwe National Education Policy (2015). All student records handled by the School Counselor shall be treated as confidential in accordance with Zimbabwean data protection legislation.
This Purchase Order may be terminated by either party with sixty (60) days' written notice. In the event of termination, the vendor shall be compensated for services rendered up to the date of termination, less any outstanding obligations.
The vendor shall maintain professional indemnity insurance with a minimum cover of USD 100,000 for the duration of this Purchase Order, and shall provide a certificate of insurance to the Harare Provincial Education Office prior to the commencement of School Counselor services.
All disputes arising from this Purchase Order shall be resolved through mediation in Zimbabwe Harare in accordance with the Mediation Act [Chapter 7:11] before any matter is referred to the High Court of Zimbabwe sitting in Harare.
This Purchase Order is subject to the availability of funds in the 2025 Provincial Education Budget, Harare, Zimbabwe. Should funds be reallocated by the Ministry of Finance and Economic Development, the terms herein shall be renegotiated in good faith.
The vendor acknowledges that the School Counselor services procured under this Purchase Order are intended to support the holistic development of learners in public secondary schools within the Harare metropolitan area and shall align with the Zimbabwean national curriculum (ZIMSEC) and the Ministry's Strategic Plan 2021–2025.
