This Purchase Order is issued by the Brussels Community Social Services Agency for the engagement of a qualified Social Worker to deliver comprehensive social support, case management, and community integration services within the Brussels Capital-Region of Belgium. The Social Worker engaged pursuant to this Purchase Order must hold a recognised Master's degree in Social Work (Maîtrise en Service Social) as awarded by a Belgian university or an equivalent qualification recognised by the Belgian Federal Ministry of Social Affairs. The Social Worker must be registered with the relevant professional body operating in Belgium Brussels and must possess a valid professional liability insurance policy with a minimum coverage of €1,000,000 per claim. All services rendered shall comply with the Belgian Data Protection Act (Loi du 30 juillet 2018 relative à la protection des personnes physiques à l'égard du traitement des données à caractère personnel) and the GDPR as applicable within the European Union.
- Commencement and Duration: Services under this Purchase Order shall commence on 1 July 2025 and shall continue for the periods specified in Section 2. The Social Worker shall be available on-site at the designated Brussels locations no later than 08:30 CET on each working day.
- Payment Schedule: Invoices shall be submitted monthly in arrears. Payment shall be made within thirty (30) calendar days of receipt of a valid invoice bearing the Purchase Order reference number PO-2025-BRU-0472. Payment shall be made via bank transfer to the account designated by the Seller in Belgium Brussels.
- Termination: Either party may terminate this Purchase Order with a written notice of sixty (60) days. In the event of material breach by the Social Worker, including but not limited to unprofessional conduct, failure to meet regulatory standards, or violation of Belgian social welfare legislation, the Buyer may terminate immediately upon written notice.
- Confidentiality: The Social Worker shall maintain strict confidentiality regarding all client information in accordance with Belgian professional secrecy obligations (secret professionnel) and the data protection regulations applicable in Belgium Brussels. No client data shall be disclosed to third parties without explicit written consent.
- Dispute Resolution: Any dispute arising from or in connection with this Purchase Order shall be resolved by the competent courts of Brussels, Belgium. The parties agree to attempt mediation through the Brussels Mediation Centre before initiating formal legal proceedings.
- Force Majeure: Neither party shall be liable for failure to perform obligations under this Purchase Order due to events beyond reasonable control, including but not limited to natural disasters, government-mandated closures, or public health emergencies affecting the Brussels Capital-Region.
- Applicable Law: This Purchase Order shall be governed by and construed in accordance with the laws of the Kingdom of Belgium, with particular reference to the Belgian Code of Obligations and the social welfare legislation of the Brussels-Capital Region.
By signing below, both parties acknowledge and agree to all terms, conditions, and service specifications set forth in this Purchase Order. The Buyer authorises the Seller to commence the engagement of the Social Worker as described herein, effective from the commencement date specified in Section 4, Clause 1.
