- This Purchase Order is issued by the Mumbai Community Welfare Foundation, a registered non-profit organisation operating under the Societies Registration Act, 1860, with its principal office in Mumbai, Maharashtra, India. All services described herein shall be rendered exclusively within the geographical jurisdiction of Mumbai and the Mumbai Metropolitan Region (MMR).
- The Social Worker engaged under this Purchase Order shall hold a valid Master's degree in Social Work (MSW) from a university recognised by the University Grants Commission (UGC), India, and shall maintain active registration with the Maharashtra State Social Work Council throughout the engagement period.
- Payment shall be made via NEFT/RTGS to the bank account specified by the Social Worker within 30 days of receipt of a valid tax invoice. Applicable TDS (Tax Deducted at Source) under Section 194J of the Income Tax Act, 1961, shall be deducted at the prevailing rate (10%) and deposited with the Indian Income Tax Department, Mumbai circle.
- The Social Worker shall comply with all applicable labour laws, data protection regulations (including the Digital Personal Data Protection Act, 2023, India), and the guidelines issued by the Municipal Corporation of Greater Mumbai (MCGM) regarding community welfare interventions in Mumbai.
- This Purchase Order is valid for acceptance within 14 calendar days from the date of issue. Failure to accept within this period shall render this Purchase Order null and void without any liability on the part of the Foundation.
- The Social Worker shall submit a detailed monthly progress report to the Director, Mumbai Community Welfare Foundation, by the 5th of each subsequent month. Reports shall include beneficiary counts, intervention outcomes, challenges encountered, and recommendations for the following month, all pertaining to work conducted in Mumbai and its suburbs.
- Any dispute arising out of or in connection with this Purchase Order shall be subject to the exclusive jurisdiction of the competent courts in Mumbai, Maharashtra, India. Both parties agree to attempt mediation before initiating any legal proceedings.
- The Social Worker shall maintain professional confidentiality regarding all beneficiary data collected during fieldwork in Mumbai. No personal information shall be disclosed to third parties without written consent, in accordance with the Foundation's data privacy policy and Indian law.
- This Purchase Order may be amended or terminated by mutual written consent. In the event of termination, the Social Worker shall be compensated for services rendered up to the date of termination, and all project files, reports, and beneficiary records pertaining to Mumbai operations shall be handed over to the Foundation within 7 working days.
- All communications related to this Purchase Order shall be in English or Hindi. Official correspondence shall be directed to the Foundation's office at Nariman Point, Mumbai – 400021, India.
