This Purchase Order is issued for the engagement of a qualified Special Education Teacher to provide dedicated instructional and support services within the Australia Brisbane metropolitan school district. The services described below are subject to the terms and conditions outlined in Section 6 of this Purchase Order and must comply with all applicable Queensland and Australian education legislation, including the Education Act 2013 (Qld) and the Disability Discrimination Act 1992 (Cth).

The Special Education Teacher shall commence duties no later than Monday, 01 August 2025, at the Brisbane City Inclusive Learning Centre located at 88 George Street, Brisbane, Queensland 4000, Australia. The contract term is for a period of twelve (12) months, with the option to extend for an additional twelve (12) months subject to mutual written agreement and satisfactory performance review. All services must be delivered within the Australia Brisbane metropolitan area unless prior written approval is granted by the Purchasing Entity for off-site professional development activities.

Payment shall be made in accordance with the following schedule, all amounts denominated in Australian Dollars (AUD):

All invoices must be submitted to the Brisbane Metropolitan Education Services Authority Procurement Division no later than the 25th of the month preceding the payment due date. Payment will be processed via electronic funds transfer (EFT) within thirty (30) calendar days of receipt of a valid tax invoice. Late payment shall attract interest at the rate prescribed under the Interest on Late Payments Act 2003 (Qld).

Qualifications and Registration: The Special Education Teacher engaged under this Purchase Order must hold a current Queensland College of Teachers (QCT) registration, a valid Working with Children Check (WWCC) issued by the Queensland Police Service, and a minimum of a Bachelor of Education (Special Education) or equivalent qualification recognised by the Australian Institute for Teaching and School Leadership (AITSL).
Compliance with Legislation: All services must be delivered in strict compliance with the Education Act 2013 (Qld), the Disability Discrimination Act 1992 (Cth), the Children's Guardian Act 2000 (Qld), and all Australia Brisbane Department of Education policies and directives in force at the time of service delivery.
Confidentiality: The Supplier and the Special Education Teacher shall maintain strict confidentiality regarding all student records, individualised education plans, and personal health information in accordance with the Privacy Act 1988 (Cth) and the Information Privacy Act 2009 (Qld).
Insurance: The Supplier must maintain, at its own cost, professional indemnity insurance of no less than AUD 10,000,000 per claim and public liability insurance of no less than AUD 20,000,000 for the duration of this Purchase Order. Certificates of insurance must be provided prior to commencement.
Performance Standards: The Special Education Teacher shall be subject to quarterly performance reviews conducted by the Purchasing Entity. Failure to meet agreed performance benchmarks for two consecutive review periods shall constitute grounds for termination of this Purchase Order with thirty (30) days' written notice.
Termination: Either party may terminate this Purchase Order by providing thirty (30) days' written notice. The Purchasing Entity may terminate immediately in the event of material breach, loss of QCT registration, or a finding of unsuitability under the Working with Children Check.
Dispute Resolution: Any dispute arising under this Purchase Order shall first be referred to mediation under the Mediation Act 2011 (Qld). If unresolved within sixty (60) days, the dispute shall be subject to the exclusive jurisdiction of the courts of Queensland, Australia Brisbane.
Intellectual Property: All lesson plans, IEPs, assessment tools, and training materials developed specifically for the Australia Brisbane school network under this Purchase Order shall remain the property of the Purchasing Entity.
Force Majeure: Neither party shall be liable for failure to perform obligations due to events beyond reasonable control, including but not limited to natural disasters, pandemics, or government-mandated school closures as may occur in the Australia Brisbane region.
Governing Law: This Purchase Order shall be governed by and construed in accordance with the laws of the State of Queensland, Australia.
