- Compliance: The Special Education Teacher engaged under this Purchase Order must hold a current NSW teaching registration with the NSW Education Standards Authority (NESA) and a valid Working with Children Check (WWCC) issued by the NSW Office of the Children's Guardian.
- Scope of Work: The Special Education Teacher shall operate in accordance with the Australian Curriculum (F-10) and the NSW K-10 Syllabus, adapting and differentiating instruction for students with disabilities, learning difficulties, and additional educational needs as documented in their Individual Education Plans (IEPs).
- Location: All services shall be delivered at the designated school sites within the Australia Sydney metropolitan area, including but not limited to locations in Inner West, Eastern Suburbs, and Northern Beaches local government areas.
- Payment Terms: Payment shall be made within 30 days of receipt of a valid tax invoice. Invoices are to be submitted to the SMSESA Accounts Payable department. Payment will be processed via electronic funds transfer (EFT) to the supplier's nominated bank account in Australia.
- Termination: Either party may terminate this Purchase Order with 30 days' written notice. In the event of termination, the Special Education Teacher's transition plan for affected students must be completed in consultation with the school principal and SMSESA case managers.
- Confidentiality: The Special Education Teacher and the supplier are bound by the Privacy Act 1988 (Cth) and the NSW Information Privacy and Protection Act 1998. All student records, assessment data, and behavioural intervention documentation must be stored in compliance with these statutes.
- Insurance: The supplier must maintain professional indemnity insurance of no less than AUD 10,000,000 and public liability insurance of no less than AUD 20,000,000 for the duration of this Purchase Order.
- Anti-Discrimination: The Special Education Teacher shall comply with the Anti-Discrimination Act 1977 (NSW) and the Disability Discrimination Act 1992 (Cth), ensuring equitable access to education for all students regardless of disability, race, gender, or cultural background.
- Dispute Resolution: Any disputes arising from this Purchase Order shall be resolved in accordance with the NSW Civil and Administrative Tribunal (NCAT) procedures or, where applicable, the Australian Consumer Law.
The Special Education Teacher shall commence duties no later than 1 August 2025, aligning with the start of the new NSW school term. All equipment, software licences, and professional development components listed in this Purchase Order must be delivered and installed prior to the commencement date. The supplier shall provide a detailed onboarding and transition plan to SMSESA no fewer than 14 days before the start date.
