- Scope of Engagement: This Purchase Order authorizes the procurement of Special Education Teacher services as described in the line items above. All services shall be rendered at the institution's campus located in Chile Santiago, specifically at Av. Providencia 1250, and at the satellite center in the Ñuñoa commune of Santiago.
- Qualifications: The Special Education Teacher(s) engaged under this Purchase Order must hold a minimum of a Licenciatura en Educación Especial or equivalent degree from a Chilean university recognized by the Ministry of Education (MINEDUC). A valid teaching license (Certificado de Aptitud Pedagógica) issued by the Superintendencia de Educación is mandatory. Additional certifications in areas such as autism spectrum disorders, learning disabilities, or sensory integration are strongly preferred.
- Compliance with Chilean Law: All services rendered under this Purchase Order shall comply with Chilean labor law (Código del Trabajo, Ley 20.422 on Inclusive Education), the Ley 21.016 on Inclusive Education, and all applicable regulations of the Superintendencia de Educación de la Región Metropolitana. The Special Education Teacher shall be subject to the same labor protections and benefits as any other employee in Chile Santiago.
- Payment Terms: Payment shall be made monthly via electronic bank transfer (transferencia electrónica) to the vendor's designated account. Invoices must be submitted by the 5th business day of each month for services rendered in the preceding month. Payment will be processed within 15 business days of invoice receipt. All amounts are denominated in Chilean Pesos (CLP) and subject to 19% IVA as per Chilean tax regulations.
- Performance Standards: The Special Education Teacher shall maintain a minimum of 95% attendance, submit monthly progress reports for each student with an IEP, and participate in all staff meetings. Failure to meet performance standards for two consecutive months may result in termination of this Purchase Order with 30 days' written notice.
- Confidentiality: The Special Education Teacher shall maintain strict confidentiality regarding all student records, medical information, and family data in accordance with Chile's Ley 19.628 on Protection of Privacy. All student information shall be stored in compliance with the institution's data protection policy.
- Termination: Either party may terminate this Purchase Order with 60 days' written notice. In the event of termination, all outstanding invoices for services already rendered shall be paid in full. The Special Education Teacher shall ensure a smooth transition plan for all students currently under their care.
- Dispute Resolution: Any disputes arising from this Purchase Order shall be resolved through mediation in Chile Santiago before proceeding to the competent courts of the Región Metropolitana. The applicable law shall be the law of the Republic of Chile.
- Force Majeure: Neither party shall be liable for delays or failures in performance resulting from events beyond reasonable control, including but not limited to natural disasters (earthquakes, tsunamis), government-mandated closures, or public health emergencies affecting Chile Santiago.
