This Purchase Order is issued by the Nairobi County Department of Education & Special Needs to procure the professional services of a qualified Special Education Teacher for deployment at the Nairobi County Integrated Special Needs Centre, located in the Westlands area of Kenya Nairobi. The engagement is intended to support the county's mandate under the Persons with Disabilities Act (2003) and the Constitution of Kenya (2010), Article 54, which guarantees the right to education for persons with disabilities.

The Special Education Teacher engaged under this Purchase Order must hold a minimum of a Bachelor of Education (Special Education) degree from a KNEC-recognized institution in Kenya, preferably a Master's degree in Special Education or a related field. The candidate must possess a valid teaching licence issued by the Teachers Service Commission (TSC) of Kenya and a minimum of three (3) years of documented experience in special education settings within Kenya Nairobi or other Kenyan counties. The teacher shall be responsible for delivering differentiated instruction, managing classroom behaviour for students with autism spectrum disorder, cerebral palsy, Down syndrome, and other special needs, and maintaining accurate student progress records in alignment with the Kenya County Education Act.

  1. This Purchase Order is governed by the laws of the Republic of Kenya, including the Public Procurement and Asset Disposal Act (2015) and its regulations.
  2. The Special Education Teacher shall commence duties no later than 01 September 2025 at the designated facility in Kenya Nairobi. Failure to commence within 14 days of the commencement date shall constitute a material breach of this Purchase Order.
  3. Payment shall be made via electronic funds transfer (EFT) to the supplier's designated bank account within thirty (30) calendar days of receipt of a valid tax invoice, subject to satisfactory performance review.
  4. The supplier shall remit all applicable taxes, including Value Added Tax (VAT) at 16% and Withholding Tax at 5%, in accordance with the Kenya Revenue Authority (KRA) regulations. The amounts stated in this Purchase Order are exclusive of VAT.
  5. The Nairobi County Department of Education reserves the right to terminate this Purchase Order with thirty (30) days' written notice in the event of unsatisfactory performance, misconduct, or failure to meet the professional standards expected of a Special Education Teacher in Kenya Nairobi.
  6. All intellectual property, lesson plans, IEPs, and assessment tools developed by the Special Education Teacher during the term of this engagement shall remain the property of the Nairobi County Department of Education.
  7. The supplier shall maintain professional indemnity insurance of not less than KES 5,000,000 for the duration of the contract.
  8. Any disputes arising from this Purchase Order shall be resolved through mediation in Nairobi, Kenya, in accordance with the Arbitration Act (Cap 49) of the Laws of Kenya.
  9. This Purchase Order does not constitute an employment relationship. The Special Education Teacher is engaged as an independent professional service provider under a contractual arrangement.
NOTE: This Purchase Order is subject to the availability of funds as approved by the Nairobi County Assembly under the 2025/2026 County Budget Allocation for Special Needs Education. The supplier shall not commence any services until written confirmation of fund availability is issued by the County Treasury, Kenya Nairobi.

By signing below, both parties acknowledge and agree to the terms, conditions, and scope of work outlined in this Purchase Order for the engagement of a Special Education Teacher in Kenya Nairobi. This document constitutes a binding agreement between the parties upon execution.
