This Purchase Order is issued by the Office of Inclusive Education & Human Resources Development, Kathmandu, Nepal, for the recruitment and engagement of a qualified Special Education Teacher to deliver inclusive education services across selected government schools in the Kathmandu Valley region. 3. TERMS AND CONDITIONS
  1. Scope of Work: The Special Education Teacher engaged under this Purchase Order shall operate exclusively within the Kathmandu Valley administrative region of Nepal Kathmandu, including the municipalities of Kathmandu, Lalitpur, and Bhaktapur. The teacher shall report directly to the District Education Officer, Kathmandu, and the Office of Inclusive Education.
  2. Qualification Requirements: The Special Education Teacher must hold a Master's degree in Special Education or a related field from a university recognized by the Tribhuvan University or Kathmandu University, Nepal. A valid teaching license issued by the Nepal Government's Department of Education is mandatory. Minimum five (5) years of documented experience in special or inclusive education settings within Nepal Kathmandu or equivalent international contexts is required.
  3. Payment Terms: Payment shall be made in four (4) equal quarterly installments via bank transfer to the account of Kathmandu Inclusive Learning Academy Pvt. Ltd. The first installment shall be due within thirty (30) days of the commencement date. Subsequent payments are contingent upon satisfactory quarterly performance reviews conducted by the Office of Inclusive Education, Nepal Kathmandu.
  4. Commencement and Duration: Services under this Purchase Order shall commence on 1 August 2025 and continue for a period of twelve (12) months, concluding on 31 July 2026, unless extended by mutual written agreement between both parties.
  5. Performance Standards: The Special Education Teacher shall conduct a minimum of 25 instructional hours per week, develop and update IEPs for all assigned students, attend all scheduled staff meetings in Nepal Kathmandu, and submit monthly activity reports to the District Education Officer.
  6. Compliance with Nepali Law: All services rendered under this Purchase Order shall comply with the Nepal Education Act, 2020; the National Policy on Inclusive Education, 2015; the Rights of Persons with Disabilities Act, 2019; and all applicable labor regulations of the Government of Nepal. The Special Education Teacher shall adhere to the code of conduct prescribed for government-affiliated educators in Nepal Kathmandu.
  7. Confidentiality: The Special Education Teacher shall maintain strict confidentiality regarding student records, IEPs, and personal information of all children with special needs. Breach of confidentiality shall result in immediate termination of this Purchase Order and legal action under the Nepal Privacy Act, 2018.
  8. Termination: Either party may terminate this Purchase Order with thirty (30) days written notice. In cases of gross misconduct, failure to meet performance benchmarks, or violation of the Nepal Education Act, the Buyer may terminate immediately without notice.
  9. Dispute Resolution: Any disputes arising from this Purchase Order shall first be resolved through amicable negotiation. If unresolved within thirty (30) days, the matter shall be referred to arbitration under the Arbitration Act, 1999 of Nepal, with the seat of arbitration in Nepal Kathmandu.
  10. Force Majeure: Neither party shall be liable for delays or failures in performance caused by natural disasters (including earthquakes common to the Nepal Kathmandu region), government-imposed lockdowns, pandemics, or other events beyond reasonable control.
  11. Intellectual Property: All IEPs, curricula, training materials, and reports developed under this Purchase Order shall become the property of the Office of Inclusive Education, Government of Nepal, and may be used for educational purposes across Nepal Kathmandu and other districts.
4. DELIVERY AND ACCEPTANCE

The Special Education Teacher shall report for duty at the designated school in Kathmandu Valley on the first working day of August 2025. Assistive technology kits shall be delivered to the central warehouse of the Office of Inclusive Education, Thapathali, Nepal Kathmandu, within fourteen (14) days of the issue date of this Purchase Order. Acceptance of services and materials shall be confirmed in writing by the District Education Officer, Kathmandu, upon satisfactory inspection.
