Important Note: This Purchase Order is issued in accordance with the Senegalese Public Procurement Code (Code des Marchés Publics) and the national Inclusive Education Policy of 2022. All services rendered by the Special Education Teacher shall be conducted in compliance with the laws of the Republic of Senegal, the conventions of the African Union on the Rights and Welfare of the Child, and the United Nations Convention on the Rights of Persons with Disabilities. The Special Education Teacher is required to maintain valid professional certification throughout the contract period and to report to the Direction Régionale de l'Éducation in Dakar on a monthly basis.Terms and Conditions
- Payment Terms: Payment shall be made in monthly installments within 30 days of receipt of the approved monthly progress report. The first installment shall be due upon successful commencement of services on 01 March 2025.
- Performance Bond: The Special Education Teacher shall provide a performance bond equivalent to 10% of the total Purchase Order value, to be released upon satisfactory completion of the 12-month contract period.
- Termination: Either party may terminate this Purchase Order with 60 days' written notice. In the event of termination for cause, the Special Education Teacher shall be compensated for services rendered up to the date of termination.
- Compliance: The Special Education Teacher shall adhere to all child protection policies, safeguarding protocols, and ethical standards as prescribed by the Ministry of National Education in Senegal Dakar. Any breach shall constitute grounds for immediate termination.
- Dispute Resolution: Any disputes arising from this Purchase Order shall be resolved through mediation before the Regional Education Directorate in Dakar. If unresolved within 30 days, the matter shall be referred to the competent courts of Dakar, Senegal.
- Force Majeure: Neither party shall be liable for delays or non-performance resulting from events beyond reasonable control, including but not limited to natural disasters, civil unrest, or government-mandated school closures in Senegal.
- Confidentiality: All student records, assessment data, and Individualized Education Plans developed under this Purchase Order shall remain the property of the issuing authority and shall be handled in strict confidence in accordance with Senegalese data protection regulations.
- Language of Service: Instructional services shall be delivered primarily in French, with supplementary materials available in Wolof and English to ensure accessibility for all students in the Senegal Dakar region.
