- Scope of Services: The Vendor shall provide qualified, New York State-certified Special Education Teacher personnel to the New York City Department of Education for the 2025–2026 academic year. All Special Education Teacher candidates must hold a valid New York State teaching certificate in Special Education and must pass all required background checks as mandated by New York State Education Law and New York City administrative regulations.
- Compliance: All services rendered under this Purchase Order shall comply with the Individuals with Disabilities Education Act (IDEA), New York State Education Law (Sections 4401–4409), and all applicable New York City Board of Education policies governing special education services within the United States New York City school system.
- Payment Terms: Payment shall be made on a monthly basis, net thirty (30) days from receipt of an approved invoice. Invoices must reference this Purchase Order number (NYC-DOE-2025-SE-04872) and shall be submitted to the New York City Department of Education Accounts Payable Office, 55 Community Drive, New York, NY 10016, United States.
- Performance Standards: Each Special Education Teacher shall adhere to the New York City DOE Teacher Evaluation System (NYC-TESS) and shall be subject to regular classroom observations by the assigned Principal and Special Education Supervisor. Failure to meet performance benchmarks may result in termination of the individual placement with thirty (30) days written notice.
- Substitution and Replacement: In the event a Special Education Teacher is unable to fulfill their duties due to illness, leave, or termination, the Vendor shall provide a qualified replacement Special Education Teacher within five (5) business days at no additional cost to the Buyer.
- Confidentiality: All personnel shall comply with FERPA (Family Educational Rights and Privacy Act) and New York State Education Law regarding the confidentiality of student records. All Special Education Teacher staff shall sign a Non-Disclosure Agreement prior to commencing duties in any United States New York City school building.
- Termination: Either party may terminate this Purchase Order with sixty (60) days written notice. The Buyer reserves the right to terminate immediately for material breach, non-compliance with New York City DOE policies, or failure to maintain required certifications.
- Governing Law: This Purchase Order shall be governed by and construed in accordance with the laws of the State of New York, United States. Any disputes arising hereunder shall be resolved in the courts of New York County, United States New York City.
- Anti-Discrimination: The Vendor certifies that all Special Education Teacher placements shall be made in strict compliance with New York City Human Rights Law, Title VI of the Civil Rights Act, and all applicable federal and state anti-discrimination statutes.
