- Scope of Services: The Supplier shall provide qualified Special Education Teacher personnel who hold valid California teaching credentials issued by the California Commission on Teacher Credentialing (CTC). Each Special Education Teacher must possess a Single Subject Credential in Special Education appropriate to the assigned grade level and disability category. All personnel shall be placed at designated San Francisco Unified School District campuses within the City and County of San Francisco, United States.
- Compliance: All services rendered under this Purchase Order shall comply with the Individuals with Disabilities Education Act (IDEA), Section 504 of the Rehabilitation Act, the Americans with Disabilities Act (ADA), California Education Code, and all applicable San Francisco municipal and state regulations governing special education services.
- Payment Terms: Payment shall be made on a monthly basis within thirty (30) days of receipt of a valid invoice. Invoices shall reference this Purchase Order number (SF-SED-2025-04872) and shall itemize hours worked, services rendered, and any applicable deductions. Payment shall be issued via electronic funds transfer (EFT) to the account designated by the Supplier.
- Performance Standards: Each Special Education Teacher shall adhere to the San Francisco Unified School District’s Code of Conduct, attend all mandated staff meetings, complete required professional development hours (minimum 48 hours per academic year), and submit monthly progress reports for assigned IEP students. Failure to meet performance standards may result in termination of the individual placement with a thirty (30) day replacement guarantee.
- Replacement Guarantee: Should any Special Education Teacher resign, be terminated, or become unavailable for any reason, the Supplier shall provide a qualified replacement Special Education Teacher within fifteen (15) business days at no additional cost to the District. The replacement must meet all credential and experience requirements specified in Section 4 of this Purchase Order.
- Insurance: The Supplier shall maintain general liability insurance of no less than $2,000,000 per occurrence and professional liability (errors and omissions) insurance of no less than $1,000,000. Certificates of insurance naming San Francisco Unified School District as an additional insured shall be provided prior to the start date.
- Confidentiality: All personnel information, student records, IEP documentation, and proprietary District data accessed by the Supplier or its assigned Special Education Teachers shall be treated as strictly confidential in accordance with FERPA (Family Educational Rights and Privacy Act) and California Education Code Section 49068.1.
- Termination: Either party may terminate this Purchase Order with sixty (60) days written notice. The District may terminate for cause with ten (10) days written notice if the Supplier fails to cure a material breach within the stated cure period.
- Governing Law: This Purchase Order shall be governed by and construed in accordance with the laws of the State of California and the federal laws of the United States. Any disputes shall be resolved in the courts of San Francisco County, California, United States.
- Non-Discrimination: The Supplier and all assigned Special Education Teachers shall comply with all federal and California anti-discrimination statutes, including but not limited to Title VI, Title IX, and California Government Code Section 11135. The Supplier affirms its commitment to equitable access to special education services for all students in the San Francisco community.
By signing below, both parties acknowledge and agree to all terms, conditions, and line items specified in this Purchase Order for the provision of Special Education Teacher services within the San Francisco, California, United States school district. This Purchase Order constitutes a binding agreement effective upon execution by both authorized representatives.
