1. Description of ProcurementThis Purchase Order is issued by the Ho Chi Minh City Inclusive Education Foundation to formally procure the professional services of a qualified Special Education Teacher for deployment at the Foundation's primary and secondary inclusive learning centers located throughout Vietnam Ho Chi Minh City. The purpose of this procurement is to ensure that students with diverse learning needs—including but not limited to intellectual disabilities, autism spectrum disorder, hearing impairments, visual impairments, and specific learning difficulties—receive high-quality, individualized instruction in accordance with the national education standards set forth by the Ministry of Education and Training of Vietnam.
The Special Education Teacher engaged under this Purchase Order shall be responsible for developing and implementing Individualized Education Programs (IEPs), conducting classroom assessments, collaborating with general education staff, parents, and multidisciplinary teams, and maintaining comprehensive student progress records. The role is specifically tailored to the educational landscape of Vietnam Ho Chi Minh City, where the Foundation operates twelve (12) inclusive classrooms across Districts 1, 3, 7, and Binh Tan.

The Special Education Teacher procured under this Purchase Order must hold a minimum of a Bachelor's degree in Special Education or a related field from an accredited institution in Vietnam or internationally, along with a valid Special Education Teaching License issued by the Ho Chi Minh City Department of Education and Training. A minimum of three (3) years of direct classroom experience working with students with disabilities in Vietnam Ho Chi Minh City or comparable urban educational settings is required. Fluency in Vietnamese is mandatory; proficiency in English is strongly preferred given the Foundation's bilingual curriculum components.
The vendor, BrightPath Educational Staffing Co., Ltd., is responsible for the recruitment, vetting, background checking, and onboarding of the Special Education Teacher. All candidate screening shall be conducted in compliance with Vietnamese labor law (Labor Code 2019) and the Law on Persons with Disabilities (2010). The vendor shall provide the Foundation with a complete candidate dossier, including academic transcripts, teaching licenses, reference letters, and a criminal background check, no fewer than ten (10) business days prior to the commencement date.
4. Terms and Conditions- Payment Terms: Payment for this Purchase Order shall be made in monthly installments via bank transfer to the vendor's designated account at Vietcombank, Ho Chi Minh City branch. Invoices are due within fifteen (15) calendar days of receipt. Late payments shall accrue interest at 0.05% per day as stipulated under Vietnamese commercial law.
- Commencement Date: The Special Education Teacher shall commence duties on 01 September 2025, aligning with the start of the 2025–2026 academic year in Vietnam Ho Chi Minh City.
- Contract Duration: This Purchase Order covers a twelve (12) month engagement period from 01 September 2025 to 31 August 2026, subject to renewal by mutual written agreement.
- Performance Standards: The Special Education Teacher shall be evaluated quarterly against the Foundation's Key Performance Indicators, which include student IEP goal attainment rates, parent satisfaction surveys, and peer collaboration metrics specific to the Vietnam Ho Chi Minh City educational context.
- Termination: Either party may terminate this Purchase Order with thirty (30) days' written notice. In cases of gross misconduct or failure to meet minimum performance thresholds, termination may be effected with seven (7) days' notice.
- Confidentiality: All student records, IEP documents, and personal data handled by the Special Education Teacher are subject to strict confidentiality under the Foundation's data protection policy and Vietnam's Personal Data Protection Decree 13/2023/NĐ-CP.
- Governing Law: This Purchase Order shall be governed by and construed in accordance with the laws of the Socialist Republic of Vietnam. Any disputes shall be resolved through the People's Court of District 1, Ho Chi Minh City.
- Force Majeure: Neither party shall be liable for delays or non-performance resulting from natural disasters, government-mandated closures, or public health emergencies affecting Vietnam Ho Chi Minh City, provided written notice is given within five (5) business days.
