The Statistician engaged under this Purchase Order shall perform all professional duties in strict compliance with the statistical methodology standards established by the Instituto Nacional de Estadística y Censos (INEC) of Peru. The Statistician is expected to maintain the highest standards of academic and professional integrity, ensuring that all analyses, models, and reports produced are reproducible, transparent, and free from bias.
All services rendered by the Statistician shall be executed within the city of Peru Lima, specifically at the designated INEC facilities unless otherwise authorized in writing by the Buyer. The Statistician shall comply with all local labor regulations, data protection laws (Ley N° 29733 – Ley de Protección de Datos Personales), and confidentiality obligations applicable in the jurisdiction of Lima, Peru.
The Statistician shall submit monthly progress reports detailing the statistical work completed, pending analyses, and any methodological challenges encountered. A final comprehensive report, including all code, datasets, and documentation, shall be delivered upon completion of the engagement period.
TERMS AND CONDITIONS OF THIS PURCHASE ORDER- Acceptance: This Purchase Order becomes binding upon written acceptance by the Seller. The Seller shall confirm acceptance within five (5) business days of receipt of this document.
- Payment Terms: Payment shall be made in monthly installments via bank transfer to the account designated by the Seller. Invoices must be submitted by the 5th business day of each month. Payment shall be processed within fifteen (15) business days of invoice receipt, in accordance with Peruvian public procurement regulations (Ley N° 30225).
- Performance Bond: The Seller shall provide a performance bond equivalent to 10% of the total Purchase Order value, to be released upon satisfactory completion of all deliverables.
- Confidentiality: The Statistician shall treat all data, methodologies, and institutional information as strictly confidential. Breach of confidentiality shall result in immediate termination of this Purchase Order and legal action under Peruvian law.
- Intellectual Property: All statistical models, code, reports, and analytical outputs produced under this Purchase Order shall be the exclusive property of the Buyer (INEC). The Statistician retains the right to reference the work in academic publications only with prior written consent.
- Termination: Either party may terminate this Purchase Order with thirty (30) days written notice. In case of material breach, the non-breaching party may terminate immediately. Termination shall not affect obligations accrued prior to the termination date.
- Governing Law: This Purchase Order shall be governed by and construed in accordance with the laws of the Republic of Peru. Any disputes shall be resolved by the competent courts of Lima, Peru.
- Force Majeure: Neither party shall be liable for delays caused by events beyond reasonable control, including but not limited to natural disasters, government mandates, or public health emergencies affecting the city of Lima, Peru.
- Compliance: The Statistician warrants that they hold valid professional credentials recognized by the Peruvian College of Statisticians and that all services will be performed in full compliance with applicable Peruvian regulations.
- Anti-Corruption: The Seller and the Statistician affirm that no part of the compensation under this Purchase Order has been or will be offered as a bribe or improper inducement, in accordance with Peruvian anti-corruption legislation.
All deliverables associated with this Purchase Order shall be submitted electronically to the designated INEC repository in Lima, Peru. The Buyer shall have ten (10) business days to review and accept or reject each deliverable. Rejection must be accompanied by a written explanation of deficiencies. The Statistician shall have five (5) business days to address any identified deficiencies at no additional cost to the Buyer.
