This Purchase Order is issued by the CHU Mustapha Pacha Public Hospital Authority, located in Algeria Algiers, to formally engage the services of a qualified Surgeon for the provision of specialized surgical procedures, post-operative care, and related medical consultations. The Surgeon contracted under this Purchase Order shall fulfill the following obligations within the jurisdiction of Algeria Algiers:
- Perform all surgical procedures in accordance with the Algerian National Health Code (Code de la Santé Publique) and the professional ethics code established by the Algerian Medical Order (Ordre National des Médecins d'Algérie).
- Maintain a valid and current medical practice license issued by the Algerian Ministry of Health, specifically registered for the city of Algiers.
- Provide a minimum of 120 in-patient surgical interventions per contract year, with a maximum permissible complication rate not exceeding 3% as monitored by the hospital's Quality Assurance Committee in Algiers.
- Be available for emergency surgical call-outs at the CHU Mustapha Pacha facility, located in the central district of Algeria Algiers, with a response time not exceeding 30 minutes from notification.
- Conduct post-operative follow-up consultations for all patients operated upon, ensuring continuity of care within the Algiers metropolitan health network.
- Deliver a minimum of four (4) teaching sessions per month for junior surgeons and medical residents, contributing to the capacity-building of the surgical department in Algeria Algiers.
- Submit monthly surgical audit reports to the hospital administration, detailing case outcomes, complication rates, and patient recovery metrics.
- Comply with all data protection and patient confidentiality requirements as stipulated by Algerian law, ensuring that all patient records generated in Algiers are stored and handled in accordance with national regulations.
- Payment shall be made in Algerian Dinars (DZD) via bank transfer to the account designated by the Surgeon, in accordance with the financial regulations of the Algerian public procurement code (Code des Marchés Publics, Law No. 23-12 of 2023).
- Invoices shall be submitted monthly by the 5th business day following the end of each calendar month. Payment shall be processed within thirty (30) calendar days of receipt of a valid invoice.
- A retention of 5% of the total contract value shall be withheld and released upon satisfactory completion of the full 12-month engagement period, subject to final audit by the hospital's internal review board in Algiers.
- All applicable taxes, including the Algerian Value Added Tax (TVA) at the prevailing rate, shall be calculated and remitted in accordance with the Algerian Tax Code. The Surgeon shall provide a valid tax identification number (NIF) registered in Algiers.
- Any additional surgical procedures beyond the 120 cases stipulated in this Purchase Order shall be billed at the agreed unit rate of 85,000 DZD per case, subject to prior written authorization from the Procurement Director.
This Purchase Order shall remain in effect for a period of twelve (12) months commencing on 1 July 2025 and expiring on 30 June 2026, unless renewed by mutual written agreement between the parties. Either party may terminate this Purchase Order with a written notice of sixty (60) days, delivered to the other party at the addresses specified in Algeria Algiers. Termination for cause, including but not limited to gross professional negligence, loss of medical license, or violation of Algerian health regulations, may be effected immediately upon written notice.
This Purchase Order shall be governed by and construed in accordance with the laws of the People's Democratic Republic of Algeria. Any dispute arising from or in connection with this Purchase Order shall be resolved through the competent courts of Algiers, Algeria. The parties agree to attempt amicable mediation through the Algerian National Mediation Center before initiating any formal legal proceedings.
By signing below, both parties acknowledge and accept all terms, conditions, and obligations set forth in this Purchase Order for the engagement of the Surgeon in Algeria Algiers.
