Purchase Order DescriptionThis Purchase Order is issued by Queensland Health – Brisbane Surgical Centre to formally engage the services of Surgeon Dr. Marcus A. Whitfield for a defined period of surgical procedures, consultations, and related clinical services to be delivered at the Brisbane Surgical Centre and affiliated hospitals within the Australia Brisbane metropolitan region. The Surgeon engaged under this Purchase Order shall perform all surgical interventions in strict accordance with the Australian Commission on Safety and Quality in Health Care (ACSQHC) National Safety and Quality Health Service (NSQHS) Standards, the Royal Australasian College of Surgeons (RACS) Code of Ethics, and all applicable Queensland Health clinical governance frameworks. All services rendered under this Purchase Order shall take place within the Australia Brisbane health district, specifically at the Brisbane Surgical Centre, the Royal Brisbane and Women's Hospital (RBWH), and the Princess Alexandra Hospital (PAH) as directed by the clinical scheduling office.

Conditions Governing This Purchase Order
- This Purchase Order is governed by the laws of the State of Queensland and the Commonwealth of Australia. Any disputes arising from the interpretation or performance of this Purchase Order shall be resolved in the courts of Australia Brisbane or by arbitration under the Queensland Uniform Arbitration Act 2011.
- The Surgeon shall maintain valid medical registration with the Australian Health Practitioner Regulation Agency (AHPRA) and current membership with the Royal Australasian College of Surgeons (RACS) for the entire duration of this Purchase Order. Proof of registration and professional indemnity insurance (minimum AUD 20,000,000) shall be provided prior to the commencement of services.
- All surgical procedures specified in this Purchase Order shall be performed at accredited facilities within the Australia Brisbane metropolitan health region. The Surgeon shall comply with all Queensland Health infection control protocols, surgical site infection prevention guidelines, and the National Patient Safety Goals.
- Payment terms: Invoices shall be submitted within 14 days of service delivery. Payment shall be processed within 30 days of receipt of a valid tax invoice in accordance with the Australian Taxation Office (ATO) requirements. Late payment shall attract interest at the rate prescribed under the Queensland Government Payment Terms Act 2018.
- The Surgeon shall provide a detailed operative report for each procedure within 72 hours of surgery completion. All clinical documentation shall be entered into the Queensland Health electronic medical records system (MediRecord) in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
- This Purchase Order may be terminated by either party with 30 days' written notice. In the event of termination, the Surgeon shall complete all scheduled procedures already booked and provide a minimum of 14 days' notice to affected patients within the Australia Brisbane community.
- The Surgeon shall participate in quarterly clinical governance reviews conducted by the Brisbane Surgical Centre Quality and Safety Committee. Failure to attend two consecutive reviews without valid medical leave shall constitute a material breach of this Purchase Order.
- All personal data and patient health information handled under this Purchase Order shall be stored and processed in compliance with the Information Privacy Act 2009 (Qld) and the Notifiable Data Breaches scheme under the Privacy Act 1988 (Cth).
