The Systems Engineer engaged under this Purchase Order must possess a minimum of a Bachelor's degree in Computer Science, Information Technology, or a related engineering discipline from a recognized institution in Ghana Accra or an internationally accredited university. The candidate must hold at least one of the following professional certifications: Cisco CCNP/CCIE, CompTIA Security+, AWS Solutions Architect, or Microsoft Certified: Azure Solutions Architect Expert. A minimum of seven (7) years of progressive experience in enterprise systems engineering, with at least three (3) years of experience working in West African or Ghanaian IT environments, is mandatory. The Systems Engineer must demonstrate proficiency in network virtualization, cloud migration, and compliance with the Ghana Data Protection Act, 2012 (Act 843).
- Payment Terms: Payment shall be made in monthly installments within thirty (30) days of receipt of a valid invoice. The initial mobilization payment of 20% of the total Purchase Order value shall be due upon contract signing. All payments shall be made in Ghana Cedis (GHS) via bank transfer to the supplier's designated account in Ghana Accra.
- Performance Bond: The supplier shall provide a performance bond equivalent to 10% of the total Purchase Order value, issued by a licensed bank operating in Ghana Accra, valid for the duration of the engagement plus sixty (60) days.
- Delivery and Commencement: The Systems Engineer must be physically present and operational at the TechSolutions West Africa Ltd. premises in Ghana Accra no later than 1 July 2025. Failure to commence within five (5) business days of the stipulated date shall entitle the purchasing party to terminate this Purchase Order without penalty.
- Intellectual Property: All work product, designs, documentation, and configurations created by the Systems Engineer in the course of fulfilling this Purchase Order shall be the exclusive property of TechSolutions West Africa Ltd. The Systems Engineer shall assign all intellectual property rights upon completion of each deliverable.
- Confidentiality: The Systems Engineer shall maintain strict confidentiality regarding all proprietary information, client data, and internal systems of the purchasing party. This obligation shall survive the termination of this Purchase Order for a period of five (5) years.
- Termination: Either party may terminate this Purchase Order with thirty (30) days' written notice. In the event of material breach by the Systems Engineer, the purchasing party may terminate immediately upon written notice, subject to applicable Ghanaian commercial law.
- Governing Law: This Purchase Order shall be governed by and construed in accordance with the laws of the Republic of Ghana. Any disputes arising hereunder shall be resolved through arbitration in Ghana Accra in accordance with the Arbitration Act, 2099 (Act 626).
- Force Majeure: Neither party shall be liable for delays or failures in performance resulting from events beyond reasonable control, including but not limited to natural disasters, civil unrest, government-imposed restrictions, or pandemics affecting operations in Ghana Accra.
- Compliance: The Systems Engineer shall comply with all applicable regulations of the National Communications Authority (NCA) of Ghana, the Data Protection Commission, and the Ghana Revenue Authority throughout the term of this Purchase Order.
- Warranty: All systems, configurations, and solutions delivered by the Systems Engineer under this Purchase Order shall carry a minimum warranty period of twelve (12) months from the date of final acceptance, during which the Systems Engineer shall rectify any defects at no additional cost.
By signing below, both parties acknowledge and agree to all terms, conditions, and specifications outlined in this Purchase Order for the engagement of a Systems Engineer in Ghana Accra. This document constitutes a binding agreement upon execution by both authorized representatives.
