This Purchase Order is issued by Apex Global Technology Solutions Co., Ltd. to formally request the recruitment, onboarding, and provision of a qualified Systems Engineer to be deployed and performing duties within the operational headquarters located in Vietnam Ho Chi Minh City. The Systems Engineer shall be responsible for the design, implementation, monitoring, and maintenance of enterprise-level IT infrastructure, including server architectures, network configurations, cloud-based platforms, and cybersecurity protocols serving the company's regional operations in Southeast Asia.
The selected Systems Engineer must possess a minimum of five (5) years of professional experience in systems engineering, hold relevant certifications (such as AWS Solutions Architect, Cisco CCNP, or Microsoft Azure Administrator), and demonstrate proven expertise in Linux/Unix server environments, virtualization technologies (VMware, Hyper-V), and automated deployment pipelines. The role is full-time, permanent, and based exclusively at the company's office in Vietnam Ho Chi Minh City.

5.1 Payment Terms: Payment shall be made within thirty (30) calendar days from the date of invoice receipt. The total amount of this Purchase Order is payable in two installments: 60% upon successful onboarding of the Systems Engineer in Vietnam Ho Chi Minh City, and 40% upon completion of the first 90-day probationary period.
5.2 Delivery / Deployment: The Supplier shall ensure that the qualified Systems Engineer is fully onboarded, equipped, and commencing duties at the Vietnam Ho Chi Minh City office no later than August 1, 2025. All work permits, temporary residence cards, and local labor registrations required by Vietnamese law shall be completed prior to the start date.
5.3 Performance Standards: The Systems Engineer shall adhere to the service-level agreements (SLAs) defined in the attached Statement of Work. Failure to meet performance benchmarks for two consecutive evaluation cycles shall entitle the Buyer to terminate this Purchase Order with a 30-day written notice.
5.4 Confidentiality: All proprietary information, system architectures, network credentials, and client data accessed by the Systems Engineer during the course of employment in Vietnam Ho Chi Minh City shall remain the exclusive property of Apex Global Technology Solutions Co., Ltd. A non-disclosure agreement (NDA) must be executed prior to the first day of work.
5.5 Governing Law: This Purchase Order shall be governed by and construed in accordance with the laws of the Socialist Republic of Vietnam. Any disputes arising from this Purchase Order shall be resolved through arbitration at the Vietnam International Arbitration Centre (VIAC) in Vietnam Ho Chi Minh City.
5.6 Cancellation Policy: The Buyer may cancel this Purchase Order in whole or in part by providing written notice at least fourteen (14) days prior to the scheduled deployment date. In the event of cancellation, the Supplier shall be compensated for documented, non-recoverable expenses incurred up to the date of cancellation.
5.7 Force Majeure: Neither party shall be liable for delays or failures in performance resulting from events beyond reasonable control, including but not limited to natural disasters, government mandates, or public health emergencies affecting operations in Vietnam Ho Chi Minh City.
By signing below, both parties acknowledge and agree to all terms, conditions, and specifications outlined in this Purchase Order for the engagement of a Systems Engineer in Vietnam Ho Chi Minh City. This document constitutes a binding agreement upon execution by both authorized representatives.
