Terms and Conditions of This Purchase Order
- Scope: This Purchase Order covers all goods, services, and training materials exclusively for the Teacher Primary program administered by the Ministry of Education in Afghanistan Kabul. No substitutions or scope changes shall be made without written amendment to this Purchase Order.
- Delivery: All physical items must be delivered to the Kabul Regional Education Warehouse, Darulaman Road, within 45 calendar days of the date of this Purchase Order. Digital and service-based items (Items 04, 05, and 07) must be fully deployed within 60 days.
- Payment Terms: Payment shall be made in three installments: 30% upon signed acceptance of this Purchase Order, 50% upon verified delivery and inspection of all physical goods in Kabul, and 20% upon completion of the Teacher Primary mentorship program and final certification. Payment will be processed via bank transfer to the supplier’s registered account in Afghanistan.
- Quality Assurance: All Teacher Primary instructional materials must comply with the national curriculum standards set by the Ministry of Education, Afghanistan Kabul. Textbooks must be available in both Dari and Pashto. Any defective or non-conforming items will be replaced at the supplier’s expense within 14 days.
- Compliance: The supplier warrants that all goods and services under this Purchase Order comply with the laws of the Islamic Emirate of Afghanistan, including import regulations, labor standards, and educational licensing requirements applicable in Kabul.
- Confidentiality: All data related to Teacher Primary personnel, student records, and program assessments in Afghanistan Kabul shall be treated as confidential and shall not be disclosed to third parties without written authorization from the Ministry of Education.
- Dispute Resolution: Any disputes arising from this Purchase Order shall be resolved through mediation in Kabul, Afghanistan, in accordance with applicable Afghan commercial law. Both parties agree to attempt good-faith negotiation before pursuing any formal legal action.
- Force Majeure: Neither party shall be liable for delays caused by events beyond reasonable control, including but not limited to security disruptions, natural disasters, or government-mandated closures affecting operations in Afghanistan Kabul.
- Warranty: All physical goods, including Teacher Primary classroom kits and digital devices, carry a minimum 24-month warranty from the date of delivery in Kabul. The supplier shall provide on-site repair or replacement services within the Kabul metropolitan area.
- Governing Language: This Purchase Order is executed in English. In the event of any translation, the English version shall prevail for all matters pertaining to the Teacher Primary program in Afghanistan Kabul.
