All goods specified in this Purchase Order shall be delivered to the respective primary school locations throughout Marseille, France, no later than 01 September 2025. The supplier, ProFournir Éducation SARL, is responsible for all transportation, insurance, and installation costs within the city of Marseille. Each Teacher Primary classroom must be fully equipped and operational prior to the commencement of the 2025–2026 academic year. The professional development training sessions (Item 05) shall be conducted at the Centre de Formation des Enseignants, 45 Rue Sainte, 13001 Marseille, France, between 15 July and 29 August 2025.
Payment for this Purchase Order shall be made in three installments: (a) 30% upon signing and confirmation of this Purchase Order; (b) 50% upon verified delivery and installation of all physical goods at the designated Marseille school sites; and (c) 20% upon completion of all training programs and final acceptance by the Direction des Services Pédagogiques. Payment shall be processed via bank transfer to the supplier's designated account within 30 calendar days of invoice receipt, in accordance with French public payment regulations applicable in France Marseille.
- This Purchase Order is subject to the French Public Procurement Code (Code de la commande publique, Décret n° 2016-360) and all applicable European Union directives governing public contracts within France.
- All goods must comply with French and European safety standards (CE marking) and be suitable for use by children aged 3 to 11 years in a Teacher Primary educational environment.
- The supplier warrants that all products are new, free from defects, and accompanied by full manufacturer warranties of no less than two (2) years.
- Any delay in delivery beyond the specified date of 01 September 2025 shall incur a penalty of 0.5% of the total Purchase Order value per calendar day of delay, up to a maximum of 10%.
- The supplier shall provide a dedicated project manager based in Marseille, France, to coordinate all delivery, installation, and training activities for the Teacher Primary staff.
- All training materials and software licenses are to be provided in French, with English supplementary resources where applicable, to support the bilingual educational framework of the Marseille primary school system.
- In the event of non-conformity, the supplier shall replace defective items within five (5) business days at no additional cost to the Municipality of Marseille.
- This Purchase Order may not be subcontracted without prior written authorization from the purchasing authority in France Marseille.
- Disputes arising from this Purchase Order shall be resolved by the competent administrative courts of Marseille, France, in accordance with French law.
- Confidentiality: Both parties agree to maintain the confidentiality of all proprietary information exchanged in connection with this Purchase Order for a period of three (3) years following its completion.
This Purchase Order is valid for acceptance within ten (10) business days of the date of issue. By signing below, the supplier acknowledges receipt of this Purchase Order and agrees to fulfill all obligations as specified herein for the benefit of the Teacher Primary community in France Marseille.
