1. This Purchase Order is issued in accordance with the procurement policies of the Malaysian Ministry of Education and applies specifically to the engagement of Teacher Primary personnel for primary-level education in the Malaysia Kuala Lumpur metropolitan region.
2. All Teacher Primary candidates placed under this Purchase Order must hold valid certification from the Lembaga Pendidikan Guru Malaysia (LPGM) and possess a minimum of a Diploma in Pendidikan (PGDP) or a Bachelor's degree in Education with a primary teaching specialisation.
3. The supplier, EduTalent Malaysia Sdn. Bhd., shall ensure that all Teacher Primary placements are completed no later than 1 August 2025, in time for the commencement of the new academic year at the Malaysia Kuala Lumpur campus.
4. Payment shall be made via bank transfer to the supplier's designated account within thirty (30) calendar days from the date of a valid invoice. Late payments shall attract interest at the rate of 5% per annum as stipulated under Malaysian commercial law.
5. The supplier guarantees a replacement period of fourteen (14) calendar days should any Teacher Primary placed under this Purchase Order resign, be terminated, or be found unsuitable within the first three (3) months of employment. The replacement Teacher Primary must meet the same qualification criteria as specified herein.
6. All Teacher Primary staff engaged under this Purchase Order shall be subject to the employment laws of Malaysia, including the Employment Act 1955, the Industrial Relations Act 1967, and all applicable regulations of the Malaysian Ministry of Human Resources.
7. The supplier shall maintain full confidentiality regarding the personal data of all Teacher Primary candidates in compliance with the Personal Data Protection Act 2010 (PDPA) of Malaysia.
8. This Purchase Order is governed by and shall be construed in accordance with the laws of Malaysia. Any disputes arising from this Purchase Order shall be resolved through the courts of Malaysia Kuala Lumpur or through arbitration under the Arbitration Act 2005.
9. This Purchase Order may be amended only by mutual written agreement between both parties. No verbal modifications shall be considered valid or binding.
10. The supplier shall provide a comprehensive Teacher Primary placement report within seven (7) working days of the completion of all placements, including CVs, qualification certificates, reference letters, and performance projections for each Teacher Primary assigned.
