- This Purchase Order is issued in accordance with the South African Public Finance Management Act (PFMA) No. 1 of 1999 and the National Treasury Regulations. All transactions are governed by the laws of the Republic of South Africa.
- The supplier shall deliver all Teacher Primary educational resources and equipment to the designated delivery address in Johannesburg, Gauteng, South Africa, no later than 01 August 2025. Late delivery shall attract a penalty of 0.5% of the total Purchase Order value per calendar day of delay, capped at 10%.
- All printed materials (Items 01, 05, 06, and 07) must be produced in South Africa and must comply with the South African Bureau of Standards (SABS) for educational publications. Multilingual content must be approved by the Gauteng Department of Education's Language Policy Committee prior to printing.
- Interactive Whiteboard Display Units (Item 02) must carry a minimum 3-year manufacturer's warranty and must be compatible with the South African Department of Basic Education's approved ICT infrastructure standards for primary schools.
- Payment shall be made within 30 (thirty) calendar days of receipt of a valid tax invoice and confirmed delivery of all line items. Payment will be processed via electronic funds transfer (EFT) to the supplier's registered bank account in South Africa.
- The supplier warrants that all Teacher Primary materials are free from intellectual property infringement and are licensed for use within the South African public education sector, specifically for primary-level educators in the Johannesburg metropolitan area and surrounding Gauteng districts.
- Any variation to this Purchase Order exceeding 5% of the total value must be approved in writing by the Provincial Director: Teacher Primary Affairs, Johannesburg, and must comply with the National Treasury's procurement thresholds.
- The supplier shall maintain full insurance coverage for all goods in transit within South Africa Johannesburg and surrounding areas until formal acceptance by the receiving officer.
- Disputes arising from this Purchase Order shall be resolved in the Magistrate's Court of Johannesburg, South Africa, or through the South African Dispute Resolution Centre as per the PFMA dispute resolution provisions.
- This Purchase Order does not constitute a guarantee of future orders. The Department reserves the right to cancel or modify this Purchase Order in accordance with applicable South African public procurement legislation.
