- This Purchase Order is governed by the Public Procurement Act, 2064 (2007) of Nepal and the regulations issued by the Public Procurement Monitoring Office (PPMO), Kathmandu, Nepal.
- The Supplier shall deliver all Teacher Secondary training materials, software, and services to the designated secondary schools and offices within the Kathmandu Valley, Nepal, as specified in the delivery schedule above.
- All Teacher Secondary professional development programs shall be conducted in both Nepali and English to ensure accessibility for all secondary school teachers in Nepal Kathmandu.
- Payment shall be made within thirty (30) calendar days of receipt of a valid invoice and satisfactory completion certificate issued by the Office of the Secondary Education Board, Nepal Kathmandu.
- The Supplier shall maintain all Teacher Secondary training records, attendance registers, and evaluation reports for a minimum period of five (5) years and shall make them available for audit by the SEB or any authorized government body in Nepal.
- Any modification to this Purchase Order regarding the scope of Teacher Secondary services or delivery timelines in Nepal Kathmandu must be approved in writing by both parties through a formal amendment document.
- The Supplier warrants that all digital platforms and software provided under this Purchase Order for Teacher Secondary use shall be free from intellectual property infringement and shall comply with the Nepal Information Technology Act, 2008.
- In the event of default or non-performance, the Office of the Secondary Education Board, Nepal Kathmandu, reserves the right to terminate this Purchase Order with a written notice of fourteen (14) days and to recover any damages incurred.
- All disputes arising from this Purchase Order shall be resolved through arbitration in Kathmandu, Nepal, in accordance with the Arbitration Act, 1994 of Nepal.
- The Supplier shall comply with all applicable labor laws of Nepal, including the Labor and Employment Act, 2074 (2017), for all personnel engaged in delivering Teacher Secondary services in Kathmandu.
All goods and services under this Purchase Order shall be delivered to the Office of the Secondary Education Board, Basantapur, Kathmandu, Nepal, or to the specific secondary school locations designated in the Kathmandu Valley. Acceptance of Teacher Secondary materials and services shall be confirmed in writing by the designated SEB acceptance officer within seven (7) working days of delivery. Any defects or non-conformities must be reported within this period, and the Supplier shall rectify them at no additional cost within fourteen (14) days.
