This Purchase Order is issued by the Instituto de Educación Secundaria "Ciudad de Valencia" for the procurement of Teacher Secondary professional services, educational materials, and related academic resources. - Delivery / Commencement: All Teacher Secondary positions referenced in this Purchase Order shall commence on 1 September 2025, coinciding with the start of the 2025–2026 academic year in the Comunitat Valenciana. The Supplier shall ensure that all Teacher Secondary personnel are in post and fully operational by the first day of the academic calendar established by the Conselleria d'Educació.
- Qualification Requirements: Every Teacher Secondary professional engaged under this Purchase Order must possess a valid "Habilitación Nacional" for the specific subject area and level (ESO or Bachillerato) as mandated by Spanish national education law (LOMLOE – Ley Orgánica 3/2020). Additional Valencian language proficiency (C1 level or above) is required for all Teacher Secondary staff, in accordance with the linguistic policy of the Generalitat Valenciana.
- Payment Schedule: Payment for this Purchase Order shall be made in quarterly instalments, due within 30 days of the end of each quarter (Q1: Sep–Nov, Q2: Dec–Feb, Q3: Mar–May, Q4: Jun–Aug). Invoices must be issued to the Buyer's administrative office in Valencia and must reference this Purchase Order number (PO-VAL-2025-04782).
- Compliance with Spanish Labour Law: The Supplier shall ensure full compliance with the Estatuto de los Trabajadores (Royal Legislative Decree 2/2015) and all applicable collective agreements for Teacher Secondary staff in the public and private education sectors of Valencia, Spain. Social security contributions (Seguridad Social) shall be managed by the Supplier in accordance with Spanish regulations.
- Performance Standards: The Teacher Secondary professionals shall adhere to the curriculum guidelines established by the Ministerio de Educación and the Conselleria d'Educació, Cultura i Esport. Annual performance evaluations shall be conducted by the Buyer's academic direction team in Valencia.
- Termination: Either party may terminate this Purchase Order with 60 days' written notice. In the event of early termination, the Buyer shall be liable for all Teacher Secondary services rendered up to the termination date, plus any non-recoverable costs incurred by the Supplier.
- Dispute Resolution: Any disputes arising from this Purchase Order shall be resolved through the competent courts of Valencia, Spain, in accordance with the Ley de Enjuiciamiento Civil. The parties agree to attempt mediation before the Colegio de Abogados de Valencia prior to initiating any judicial proceedings.
- Data Protection: All personal data processed under this Purchase Order shall comply with the General Data Protection Regulation (GDPR) and the Spanish Organic Law 3/2018 (LOPDGDD). The Supplier shall act as a data processor on behalf of the Buyer for all Teacher Secondary staff records.
- Force Majeure: Neither party shall be liable for failure to perform obligations under this Purchase Order due to events beyond reasonable control, including but not limited to natural disasters, pandemics, or government-mandated school closures in Valencia or the wider Comunitat Valenciana.
