This Purchase Order is issued by NetComm Solutions GmbH to engage the services of a qualified Telecommunication Engineer to perform network infrastructure design, deployment, and maintenance activities within the metropolitan area of Germany Berlin. The Telecommunication Engineer shall be responsible for the end-to-end implementation of fiber-optic backbone connections, 5G small-cell installations, and legacy copper-line migration across the districts of Mitte, Charlottenburg-Wilmersdorf, and Tempelhof-Schöneberg. All work shall comply with the regulations of the Federal Network Agency (Bundesnetzagentur) and applicable DIN/ETSI standards governing telecommunications infrastructure in Germany.
The Telecommunication Engineer must hold a valid certification from the German Federal Office for Information Security (BSI) and demonstrate a minimum of eight (8) years of professional experience in telecommunications network engineering. The engineer shall report directly to the Project Director at NetComm Solutions GmbH and shall be physically present at the designated project sites in Germany Berlin during standard business hours (Monday through Friday, 08:00–17:00 CET), with availability for on-call support during critical deployment windows.

The Telecommunication Engineer shall commence all duties no later than 1 July 2025 at the NetComm Solutions GmbH headquarters located in Germany Berlin. The full engagement period under this Purchase Order is estimated at twelve (12) weeks, subject to milestone acceptance by the Buyer. Any extension beyond the initial period shall require a written amendment to this Purchase Order signed by both parties.
- Payment Terms: Invoices shall be submitted monthly in arrears. Payment is due within thirty (30) calendar days of invoice receipt via SEPA bank transfer to the IBAN specified in Section 2. Late payments shall accrue interest at the statutory rate under German commercial law (HGB § 288).
- Performance Bond: The vendor shall provide a performance bond equivalent to 10% of the total Purchase Order value, to be released upon final acceptance of all deliverables in Germany Berlin.
- Confidentiality & Data Protection: The Telecommunication Engineer shall sign a Non-Disclosure Agreement (NDA) and comply fully with the EU General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG) for all data encountered during the engagement.
- Insurance: The vendor shall maintain professional liability insurance of no less than EUR 2,000,000 per occurrence, valid throughout the territory of Germany, with NetComm Solutions GmbH named as an additional insured party.
- Termination: Either party may terminate this Purchase Order with fourteen (14) days' written notice. In the event of termination for convenience, the Buyer shall pay for all services rendered up to the effective date of termination.
- Governing Law & Jurisdiction: This Purchase Order shall be governed by the laws of the Federal Republic of Germany. Any disputes shall be subject to the exclusive jurisdiction of the competent courts in Berlin, Germany.
- Compliance: All telecommunications work performed in Germany Berlin shall adhere to the Telecommunications Act (Telekommunikationsgesetz — TKG), the Federal Immission Control Act (BImSchG), and all applicable municipal building and zoning regulations of the City of Berlin.
- Warranty: The Telecommunication Engineer warrants that all installations and configurations shall be free from defects for a period of twenty-four (24) months from the date of final acceptance.
