This Purchase Order is issued by Atlantic Telecom Infrastructure (Pty) Ltd for the procurement of a qualified Telecommunication Engineer to be deployed and rendered on-site in South Africa Cape Town. The Telecommunication Engineer shall be responsible for the design, installation, commissioning, and ongoing maintenance of fibre-optic and wireless telecommunication infrastructure across the buyer's network nodes situated in the Cape Town metropolitan area, including but not limited to the districts of Sea Point, Green Point, Woodstock, and the Cape Town CBD.

The Telecommunication Engineer engaged under this Purchase Order must hold a minimum of a National Diploma in Telecommunications Engineering (NQF Level 6) or a BEng degree in Electrical/Electronic Engineering with a specialisation in Telecommunications, as recognised by the Council for the Advancement of the South African Qualifications Authority (SAQA). The Telecommunication Engineer must also be a registered member of the Engineering Council of South Africa (ECSA) and hold a valid South African professional indemnity insurance certificate with a minimum cover of ZAR 5,000,000.

All services rendered by the Telecommunication Engineer shall be performed in strict compliance with the South African Telecommunications Act 1996 (Act No. 112 of 1996), the regulations of the Independent Communications Authority of South Africa (ICASA), and all applicable municipal by-laws governing telecommunication infrastructure in the City of Cape Town.

All prices are quoted in South African Rand (ZAR) and are inclusive of all travel, accommodation, and subsistence costs for the Telecommunication Engineer team within the South Africa Cape Town metropolitan area. Any travel outside the Cape Town metro area will be billed at cost with prior written approval from the buyer.

The Telecommunication Engineer team shall commence on-site work in South Africa Cape Town no later than 1 July 2025. The full project duration under this Purchase Order is six (6) months, with a possible extension of up to three (3) additional months subject to mutual written agreement. The Telecommunication Engineer shall submit weekly progress reports every Friday and a comprehensive monthly technical report by the 5th business day of the following month. All deliverables must be submitted electronically to the buyer's project management office in Cape Town.

5.1 This Purchase Order is governed by the laws of the Republic of South Africa. Any disputes arising from this Purchase Order shall be subject to the exclusive jurisdiction of the High Court of South Africa, Cape Town Division.

5.2 The Telecommunication Engineer and all supporting personnel must comply with the buyer's site safety protocols, the Occupational Health and Safety Act 85 of 1993, and all applicable South African labour legislation, including the Basic Conditions of Employment Act 75 of 1997.

5.3 The supplier shall not subcontract any portion of the Telecommunication Engineer services without prior written consent from the buyer. Any approved subcontracting shall not relieve the supplier of its obligations under this Purchase Order.

5.4 Payment shall be made within thirty (30) calendar days of receipt of a valid tax invoice. Late payments shall attract interest at the rate prescribed by the Late Payment of Interest and Costs Act 15 of 2015.

5.5 The buyer reserves the right to terminate this Purchase Order with thirty (30) days' written notice in the event of material breach, insolvency, or failure to meet the performance standards outlined in the attached Service Level Agreement (SLA).

5.6 All intellectual property, design documents, and technical data produced by the Telecommunication Engineer in the course of this engagement shall vest in the buyer upon full payment.

5.7 The Telecommunication Engineer shall maintain full professional indemnity and public liability insurance throughout the duration of this Purchase Order and shall provide certificates of insurance upon request.

This Purchase Order has been reviewed and approved in accordance with the buyer's internal procurement policy and the Public Finance Management Act 1 of 1999 (where applicable). The undersigned officers confirm that they have the authority to bind their respective parties to the terms set forth in this Purchase Order for the engagement of the Telecommunication Engineer in South Africa Cape Town.
