5. TERMS AND CONDITIONS- Governing Law: This Purchase Order shall be governed by and construed in accordance with the laws of the Islamic Republic of Pakistan, including the Sindh Universities Act, 1976, and the Higher Education Commission (HEC) Regulations, 2020, as applicable to academic appointments in Pakistan Karachi.
- Payment Terms: The University of Karachi shall disburse the monthly teaching stipend within 15 (fifteen) working days of the end of each calendar month, subject to submission of a signed attendance and performance certificate by the Head of Department. Thesis supervision fees shall be paid in two equal installments: 50% upon submission of the thesis draft and 50% upon successful viva voce.
- Performance Standards: The University Lecturer shall adhere to the academic calendar, syllabus, and quality benchmarks prescribed by the University of Karachi and the HEC. Failure to maintain a minimum student evaluation score of 75% over two consecutive semesters may result in termination of this Purchase Order with 30 days' written notice.
- Confidentiality: The University Lecturer shall treat all student records, examination papers, research data, and institutional documents as strictly confidential. Breach of confidentiality shall be subject to disciplinary action under the University of Karachi Staff Regulations and applicable Pakistani law.
- Intellectual Property: Any research publications, teaching materials, or curricula developed specifically under the scope of this Purchase Order while at the University of Karachi, Pakistan Karachi, shall be jointly owned by the University and the University Lecturer, with the University retaining the right of first use for academic purposes.
- Termination: Either party may terminate this Purchase Order by providing 30 (thirty) days' written notice. In cases of gross misconduct, unprofessional behavior, or violation of HEC code of conduct, the University may terminate immediately without notice.
- Dispute Resolution: Any dispute arising from this Purchase Order shall first be attempted to be resolved through internal grievance mechanisms of the University of Karachi. If unresolved within 30 days, the matter shall be referred to the Sindh Ombudsman or the competent court of law in Karachi, Pakistan.
- Force Majeure: Neither party shall be liable for failure to perform obligations due to events beyond reasonable control, including but not limited to natural disasters, government-imposed lockdowns, or pandemics, as may be declared by the Government of Sindh or the Government of Pakistan.
- Compliance: The University Lecturer warrants that he/she holds valid qualifications recognized by the HEC, Pakistan, and that all information provided in the application is true and accurate. Any misrepresentation shall render this Purchase Order void ab initio.
- Entire Agreement: This Purchase Order, together with the attached appointment letter and the University of Karachi Staff Regulations, constitutes the entire agreement between the parties and supersedes all prior negotiations, representations, or agreements relating to the engagement of the University Lecturer.
