The Welder units and all associated equipment must be delivered in their original manufacturer packaging, securely crated for transport. The supplier is responsible for all logistics, insurance, and risk of loss until the Welder and ancillary items are physically received and signed for at the Birmingham premises. Delivery must be completed no later than 28 June 2025. The supplier must coordinate with our site manager, Mr. James Okafor (Tel: +44 7700 900123), at least 48 hours prior to the scheduled delivery to arrange a suitable loading bay and forklift access at the Birmingham site.

  1. Payment Terms: 30% deposit upon acceptance of this Purchase Order; 60% upon delivery and physical inspection of the Welder and all items at the Birmingham facility; 10% balance within 30 days of successful commissioning and completion of operator training. All payments to be made by BACS transfer to the supplier's designated UK bank account.
  2. Warranty: The supplier shall provide a minimum 24-month comprehensive warranty on the Welder units (primary and secondary) covering all mechanical, electrical, and electronic components. Consumables and PPE are excluded from warranty. Any warranty claims must be reported in writing within 14 days of defect identification.
  3. Compliance: All equipment supplied under this Purchase Order must carry valid CE marking and comply with the UK Supply of Machinery (Safety) Regulations 2008, the UK Electricity at Work Regulations 1989, and all relevant Health and Safety Executive (HSE) guidance applicable to welding operations in the United Kingdom.
  4. Acceptance: Upon delivery at the Birmingham site, our engineering team will conduct a 72-hour acceptance test of the Welder units under normal operating conditions. The equipment shall be deemed accepted only after this test period is completed without critical fault. Any non-conformance must be rectified by the supplier at no additional cost within 10 working days.
  5. Intellectual Property & Documentation: The supplier must provide full UK-English operation and maintenance manuals, electrical schematics, and all relevant conformity certificates for the Welder units prior to or at the time of delivery.
  6. Force Majeure: Neither party shall be liable for delays caused by events beyond reasonable control, including but not limited to severe weather affecting transport routes to Birmingham, national industrial action, or government-imposed restrictions.
  7. Governing Law: This Purchase Order shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.
  8. Confidentiality: Both parties agree to treat all commercial terms, pricing, and technical specifications contained in this Purchase Order as confidential and not to disclose them to third parties without prior written consent.

This Purchase Order is issued and authorised by the undersigned on behalf of Midlands Industrial Fabrication Ltd. The supplier is requested to confirm acceptance of all terms by signing and returning a copy of this document within five (5) working days of the issue date. Failure to confirm within this period shall be taken as a declination of this Purchase Order, and the Welder procurement shall be re-tendered.
