- Payment terms: 50% deposit upon acceptance of this Quotation Estimate, with the remaining 50% payable within thirty (30) days of project completion or upon delivery of the final report, whichever occurs first. Invoices are subject to standard Australian commercial payment practices.
- The Biomedical Engineer shall comply with all applicable Australian and New South Wales legislation, including the Health Records Act 2001 (NSW), the Privacy Act 1988 (Cth), and the Therapeutic Goods Act 1989 (Cth).
- All work shall be performed in accordance with the Australian Standard AS/NZS 3544 (Electrical and electronic equipment in health care facilities) and relevant ISO standards. The Biomedical Engineer holds current professional indemnity insurance with a minimum cover of AUD $10,000,000.
- Any variation to the scope of work must be agreed in writing by both parties prior to commencement. Variations exceeding 10% of the total Quotation Estimate value will require a revised Quotation Estimate document.
- Intellectual property generated specifically for the Client under this engagement shall vest in the Client upon full payment. General methodologies, templates, and pre-existing knowledge of the Biomedical Engineer remain the property of Whitfield Biomedical Engineering Solutions Pty Ltd.
- This Quotation Estimate does not constitute a binding contract until formally accepted in writing by the Client and countersigned by the Provider. Acceptance may be communicated via email to the address listed above.
- Disputes arising from this Quotation Estimate or the subsequent engagement shall be resolved in accordance with the laws of the State of New South Wales, Australia, and shall be subject to the exclusive jurisdiction of the courts of Sydney, NSW.
