- This Quotation Estimate is valid for thirty (30) calendar days from the date of issue. Prices are quoted in Malaysian Ringgit (MYR) and are inclusive of all travel, accommodation, and logistics costs within the Malaysia Kuala Lumpur metropolitan area.
- Payment terms: 30% advance payment upon acceptance of this quotation, 40% upon completion of on-site installation and calibration works, and 30% upon final acceptance and handover of all documentation. Payment is due within fourteen (14) days of invoice date.
- All services will be performed by a licensed Biomedical Engineer registered with the Biomedical Engineering Society of Malaysia (BEM) and holding a valid professional practice certificate issued by the relevant Malaysian regulatory body.
- The Biomedical Engineer assigned to this project shall comply with all occupational health and safety requirements under the Occupational Safety and Health Act 1994 (OSHA) as applicable in Malaysia Kuala Lumpur.
- Warranty: All calibration and repair work is covered by a twelve (12) month warranty from the date of completion. The BME-MS software carries a two (2) year warranty including software updates.
- Any additional work or scope changes beyond the items listed in this Quotation Estimate will be subject to a separate written amendment and additional cost approval by both parties.
- Confidentiality: All patient data, hospital operational information, and proprietary technical documents encountered during the engagement shall be treated as strictly confidential in accordance with the Personal Data Protection Act 2010 (PDPA) of Malaysia.
- Force Majeure: Neither party shall be liable for delays caused by events beyond reasonable control, including but not limited to natural disasters, government-imposed restrictions, or pandemics affecting operations in Malaysia Kuala Lumpur.
- Governing Law: This agreement shall be governed by and construed in accordance with the laws of Malaysia. Any disputes shall be resolved through arbitration in Kuala Lumpur in accordance with the rules of the Asian International Arbitration Centre (AIAC).
