The following terms govern this Quotation Estimate for Biomedical Engineer services in Vietnam Ho Chi Minh City:
3.1 Validity: This Quotation Estimate is valid for thirty (30) calendar days from the date of issue. After the expiration date, pricing may be subject to revision based on market conditions, exchange rate fluctuations, or changes in regulatory requirements within Vietnam.
3.2 Payment Terms: Payment shall be made via bank transfer to the account of MediTech Solutions Vietnam Co., Ltd. A 40% advance payment is due upon contract signing. The remaining 60% shall be paid in two equal installments: 30% upon completion of 50% of the scope of work, and 30% upon final acceptance and delivery of all deliverables. Payment is due within fifteen (15) business days of invoice issuance.
3.3 Delivery and Location: All Biomedical Engineer services shall be performed at the client's designated facility within the administrative boundaries of Ho Chi Minh City, Vietnam. Travel and accommodation costs for the engineering team are included in the quoted prices for services performed within a 30-kilometer radius of District 1, Ho Chi Minh City.
3.4 Regulatory Compliance: All Biomedical Engineer activities shall comply with the Law on Medical Examination and Treatment (Law No. 15/2023/QH15), Decree 96/2023/NĐ-CP on medical device management, and all applicable standards issued by the Ministry of Health of Vietnam. The Biomedical Engineer team shall hold valid professional licenses and certifications recognized by Vietnamese authorities.
3.5 Intellectual Property: All reports, calibration certificates, and technical documentation produced under this engagement shall become the property of the client upon full payment. MediTech Solutions Vietnam Co., Ltd. retains the right to use anonymized data for internal quality improvement purposes.
3.6 Warranties: All calibration and maintenance work performed by our Biomedical Engineer team carries a warranty period of twelve (12) months from the date of service completion, covering workmanship and procedural accuracy. This warranty does not extend to failures caused by misuse, unauthorized modification, or force majeure events.
3.7 Force Majeure: Neither party shall be liable for delays or failures in performance resulting from events beyond reasonable control, including but not limited to natural disasters, government-mandated closures, or changes in national health emergency protocols in Vietnam Ho Chi Minh City.
3.8 Dispute Resolution: Any disputes arising from this Quotation Estimate or the resulting contract shall be resolved through amicable negotiation. If unresolved within thirty (30) days, the matter shall be submitted to arbitration under the Vietnam International Arbitration Centre (VIAC) in Ho Chi Minh City.
By signing below, the client acknowledges receipt of this Quotation Estimate and agrees to the terms, scope, and pricing outlined for the Biomedical Engineer services to be rendered in Vietnam Ho Chi Minh City. This document does not constitute a binding contract until a formal service agreement is executed by both parties.
