4. Payment Terms & Conditions
This Quotation Estimate is valid for thirty (30) calendar days from the date of issue. All prices are quoted in Euro (EUR) and include all applicable German taxes unless otherwise stated. Payment is due within fourteen (14) days of invoice issuance via bank transfer to the account of Pharmacie Berlin GmbH (IBAN: DE89 3704 0044 0532 0130 00, BIC: COBADEFFXXX). Late payments shall incur interest at the statutory rate under German commercial law (HGB § 288). This estimate does not constitute a binding contract until formally accepted in writing by both parties.
5. General Terms & Conditions – Chemist Services in Germany Berlin
- All pharmaceutical and chemical products supplied under this Quotation Estimate shall be sourced exclusively from licensed German and EU-approved manufacturers and distributors, in full compliance with the German Medicines Act and EU Directive 2001/83/EC.
- The Chemist (pharmacy) is responsible for the proper storage, temperature control, and secure handling of all supplied products in accordance with the Berlin State Pharmacy Regulations (Berliner Apothekenverordnung).
- Any changes to the scope of services, product quantities, or delivery schedules must be agreed upon in writing by both parties. Amendments to this estimate will be documented in a supplementary addendum.
- Pharmacie Berlin GmbH reserves the right to substitute equivalent products in the event of supply shortages, provided that the therapeutic or chemical equivalence is confirmed in writing by the responsible pharmacist.
- All data processing and patient-related information handled under this agreement shall comply with the German Federal Data Protection Act (BDSG) and the EU General Data Protection Regulation (GDPR).
- Disputes arising from this Quotation Estimate shall be governed by the laws of the Federal Republic of Germany, with exclusive jurisdiction of the competent courts in Berlin, Germany.
