General Terms — Chemist Services in Frankfurt, Germany
- This Quotation Estimate is valid for a period of thirty (30) calendar days from the date of issue. After the expiry date, all prices and availability of pharmaceutical products are subject to revision by the Chemist.
- All services rendered by the Chemist are governed by the German Pharmacy Act (Apothekengesetz), the German Federal Act on Medicines (Arzneimittelgesetz), and the professional code of conduct of the Hessian Chamber of Pharmacists (Apothekenkammer Hessen), Frankfurt am Main.
- Payment terms: Net 30 days from the date of invoice. Invoices shall be issued in Euro (EUR) and payable via bank transfer to the Chemist's registered account in Frankfurt, Germany. Late payments shall incur statutory interest at the rate prescribed under Section 288 of the German Civil Code (BGB).
- All pharmaceutical products supplied under this Quotation Estimate are subject to the German Pharmacopoeia (Deutsches Arzneibuch) quality standards. Batch numbers and expiry dates shall be documented and provided with each delivery.
- The Chemist reserves the right to substitute any OTC product with an equivalent of equal or superior quality should the original item be temporarily unavailable in the Frankfurt market. Such substitutions will be communicated in writing prior to dispatch.
- On-site services in Frankfurt am Main shall be conducted during standard business hours (Monday to Friday, 08:00–18:00 CET). Any after-hours or weekend deployment will be subject to a 50% surcharge and prior written agreement.
- Confidentiality: All patient and employee health data processed by the Chemist shall be handled in strict compliance with the EU General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (Bundesdatenschutzgesetz, BDSG). Data shall be stored exclusively on servers located within Germany.
- This Quotation Estimate does not constitute a binding contract until formally accepted in writing by both parties. Acceptance shall be indicated by signature and date in the blocks below.
- Any disputes arising from this Quotation Estimate or the subsequent Chemist services agreement shall be subject to the exclusive jurisdiction of the competent courts in Frankfurt am Main, Germany.
- The Chemist maintains professional indemnity insurance with a coverage of no less than 5,000,000 EUR, valid throughout the territory of Germany. A certificate of insurance shall be provided upon request.
