General Conditions
- This Quotation Estimate is valid for a period of thirty (30) calendar days from the date of issue. After this period, all prices and availability of the Civil Engineer services must be renegotiated.
- All prices are quoted in Brazilian Reais (BRL) and are inclusive of the Civil Engineer's professional fees, travel within the Federal District of Brasília, and standard office expenses. Travel outside Brasília or the Federal District will be billed separately at cost.
- The Civil Engineer shall register the appropriate Anotação de Responsabilidade Técnica (ART) with CREA-DF prior to the commencement of each phase of work, as mandated by Brazilian federal law (Law No. 5,194/1966 and Decree No. 82,443/1979).
- Payment milestones are tied to the completion of specific deliverables as outlined in the project schedule. Invoices shall be issued upon milestone completion and are payable within fifteen (15) business days via bank transfer (TED/PIX) to the account specified on the invoice.
- Any changes in scope, additional structural elements, or modifications to the original design request in Brasília shall be subject to a supplementary Quotation Estimate issued by the Civil Engineer prior to execution.
- The Civil Engineer warrants that all structural designs comply with current ABNT standards and the building code of the Distrito Federal. The Civil Engineer shall maintain professional liability insurance (Seguro de Responsabilidade Civil Profissional) with a minimum coverage of R$ 2,000,000.00 for the duration of the project.
- This Quotation Estimate does not constitute a binding contract until both parties execute a formal Service Agreement (Contrato de Prestação de Serviços) in accordance with the Brazilian Civil Code (Código Civil, Law No. 10,406/2002).
- Disputes arising from this Quotation Estimate or the subsequent contract shall be resolved by arbitration in Brasília — DF, under the rules of the Câmara de Mediação e Arbitragem of the Federal District, in the Portuguese language.
- The Civil Engineer reserves the right to withdraw from this Quotation Estimate if the client fails to provide access to the project site in Brasília or to supply necessary geotechnical and architectural documentation within the agreed timelines.
- All intellectual property rights in the structural designs, calculations, and technical reports produced by the Civil Engineer shall remain with the Civil Engineer until full payment of the Grand Total is received. Upon full payment, the client receives a non-exclusive license to use the designs for the specific project in Brasília.
