All payments are due within fourteen (14) calendar days from the date of invoice. Late payments shall attract interest at the rate of 2% per month or the maximum rate permitted under Malaysian law, whichever is lower.
4. Terms and Conditions- This Quotation Estimate is valid for thirty (30) days from the date of issue. Beyond this period, rates and availability of the Environmental Engineer team are subject to review.
- All services shall be performed in strict compliance with the Environmental Quality Act 1974, the Environmental Quality Regulations, and all applicable local by-laws of the Kuala Lumpur City Hall (DBKL) in Malaysia Kuala Lumpur.
- The Environmental Engineer and supporting team shall maintain full professional indemnity insurance coverage of not less than RM 5,000,000 for the duration of the engagement.
- The client shall provide timely access to the project site in Malaysia Kuala Lumpur, all relevant planning documents, and cooperation with regulatory authorities to enable the Environmental Engineer to perform duties without undue delay.
- Confidentiality: All data, reports, and findings generated under this Quotation Estimate engagement shall be treated as confidential and shall not be disclosed to third parties without written consent from the client.
- Force Majeure: Neither party shall be liable for delays or failures in performance resulting from events beyond reasonable control, including but not limited to natural disasters, government-imposed restrictions, or public health emergencies affecting Malaysia Kuala Lumpur.
- Dispute Resolution: Any disputes arising from this Quotation Estimate shall be resolved through mediation in Malaysia Kuala Lumpur in accordance with the rules of the Asian International Arbitration Centre (AIAC). Failing mediation, disputes shall be subject to the exclusive jurisdiction of the courts of Malaysia.
- This Quotation Estimate does not constitute a binding contract until a formal Service Agreement is executed by both parties.
