4. Payment Terms
This Quotation Estimate is subject to the following payment schedule: 30% advance payment (€28,117.32) due upon written acceptance of this quotation; 40% (€37,489.76) due upon completion of all on-set direction days in Germany Berlin; and the remaining 30% (€28,117.32) due within fourteen (14) calendar days following final delivery of the completed documentary. All payments shall be made via bank transfer to the account of Berlin Creative Productions GmbH, IBAN: DE89 3704 0044 0532 0130 00, BIC: COBADEFFXXX. Late payments shall incur interest at the statutory rate of 8% above the European Central Bank base rate, in accordance with Section 288 of the German Civil Code (BGB).
5. Terms and Conditions
5.1 This Quotation Estimate is valid for thirty (30) days from the date of issue. After the expiry date, all rates and availability of the Film Director are subject to reconfirmation and potential revision.
5.2 The Film Director engaged under this quotation shall be Marcus Weber (or an equally qualified substitute approved in writing by the client). The director holds a professional license issued by the German Film Academy and is a registered member of the German Film Directors Association (Deutscher Regiererverband).
5.3 All filming activities in Germany Berlin are subject to obtaining the necessary location permits from the relevant Berlin municipal authorities. The client is responsible for securing all filming permits, and the Film Director shall provide technical documentation and site plans to support the permit application process.
5.4 Intellectual property rights in the final documentary shall vest in the client upon full payment. The Film Director retains the right to display the work in professional portfolios, festival submissions, and industry showcases, subject to a 90-day embargo from the official premiere date.
5.5 This agreement is governed by the laws of the Federal Republic of Germany. Any disputes arising from this Quotation Estimate or the services described herein shall be subject to the exclusive jurisdiction of the competent courts in Berlin, Germany.
5.6 Cancellation by the client after the pre-production phase has commenced shall result in the client being liable for all costs incurred up to the date of cancellation, in addition to 25% of the remaining contract value as a cancellation fee.
5.7 The Film Director shall comply with all applicable health and safety regulations in Germany, including those set forth by the German Social Accident Insurance (Deutsche Gesetzliche Unfallversicherung – DGUV) for film production environments.
6. Acceptance and Authorization
By signing below, the client acknowledges and accepts this Quotation Estimate for Film Director services to be performed in Germany Berlin, and agrees to all terms, conditions, and payment schedules outlined herein.
