All fees quoted in this Quotation Estimate are denominated in Brazilian Reais (BRL) and are subject to the following payment schedule, unless otherwise agreed in writing in the formal retainer agreement:
- 30% advance payment (R$ 27.870,00) due upon signing of the retainer agreement and power of attorney, prior to the commencement of any legal work.
- 40% intermediate payment (R$ 37.160,00) due upon the filing of the initial complaint or the conclusion of the first-instance proceedings, whichever occurs first.
- 30% final payment (R$ 27.870,00) due upon the conclusion of the enforcement phase or the final resolution of the matter, including any appellate proceedings.
Payments shall be made via bank transfer (TED/PIX) to the firm's account at Banco do Brasil, Ag. 1234-5, Conta Corrente 67890-1, in the name of Almeida & Costa Advocacia S/S, CNPJ 12.345.678/0001-90, located in São Paulo, SP, Brazil. Late payments shall accrue a monthly interest rate of 1% (one percent) plus a 2% penalty, in accordance with Brazilian commercial practice.
- This Quotation Estimate is valid for a period of thirty (30) calendar days from the date of issue. After this period, the fees may be revised to reflect changes in the firm's internal rate card, inflation adjustments, or modifications in the scope of the Lawyer services required.
- The estimated hours and fees presented herein are good-faith projections based on the information available at the time of this Quotation Estimate. The actual number of hours may vary depending on the complexity of the case, the conduct of the opposing party, and procedural developments in the São Paulo courts. The client will be notified in writing of any material deviation exceeding 15% of the estimated hours before additional work is performed.
- The Lawyer services described in this document are to be performed exclusively by attorneys registered with the OAB/SP and licensed to practice law in the State of São Paulo, Brazil. The firm reserves the right to assign qualified associates to specific tasks under the supervision of the designated partner.
- This Quotation Estimate does not include services related to matters outside the State of São Paulo or before federal courts (Justiça Federal) unless expressly stated in a supplementary agreement. Any additional jurisdictional work will be quoted separately.
- The client acknowledges that the Lawyer cannot guarantee a specific outcome in any legal proceeding. All representations of likelihood or probability are based on the current state of Brazilian law and the facts known at the time of this estimate.
- Confidentiality: All information exchanged in connection with this Quotation Estimate and any subsequent engagement shall be treated as strictly confidential in accordance with the OAB/SP Code of Ethics and the Brazilian General Data Protection Law (LGPD — Law No. 13.709/2018).
- Disputes arising from this Quotation Estimate or the subsequent retainer agreement shall be resolved by the competent courts of the city of São Paulo, State of São Paulo, Brazil, with express waiver of any other jurisdiction, however privileged it may be.
- This document is issued in two (2) original copies of equal value, one for each party.
By signing below, the client acknowledges receipt of this Quotation Estimate and authorizes Almeida & Costa Advocacia to proceed with the engagement of the Lawyer services described herein, subject to the execution of a formal retainer agreement. This signature does not constitute acceptance of the terms; formal acceptance requires the execution of the separate retainer contract.
