- Binding Nature: This Quotation Estimate constitutes a binding offer by the Lawyer for the legal services described herein. Acceptance by the client shall be deemed to form a binding attorney-client engagement agreement governed by the laws of Germany, specifically the state of Berlin.
- Validity Period: This estimate is valid for thirty (30) calendar days from the date of issue. Should the client wish to proceed after the expiry date, the Lawyer reserves the right to reissue the Quotation Estimate at updated rates in accordance with the current RVG fee schedule applicable in Berlin, Germany.
- Payment Terms: Unless otherwise agreed in writing, all fees are payable within fourteen (14) days of invoice issuance. - Confidentiality: The Lawyer shall maintain strict professional confidentiality in accordance with § 43a BRAO and the General Data Protection Regulation (GDPR / DSGVO). All client data shall be processed and stored in compliance with German data protection law.
- Professional Liability Insurance: The Lawyer maintains professional indemnity insurance (Berufshaftpflichtversicherung) in accordance with § 51 BRAO, with a minimum coverage of €2,500,000 per claim, as required for all practising lawyers in Germany Berlin.
- Dispute Resolution: Any dispute arising from this engagement shall be subject to the exclusive jurisdiction of the competent courts in Berlin, Germany. The parties agree to attempt mediation before the Berlin Bar Association (Rechtsanwaltskammer Berlin) prior to initiating formal proceedings.
- Language of Services: All legal documents, court filings, and correspondence shall be prepared in German, as required by the courts of Berlin, Germany. Translations into English or other languages shall be billed as out-of-pocket expenses.
