2. Scope of Legal Services (Lawyer Engagement)
This Quotation Estimate is issued by the undersigned Lawyer, a duly registered member of the Ilustre Colegio de la Abogacía de Madrid (ICAM), in accordance with the Spanish Lawyers' Statute (Estatuto General de la Abogacía, Ley 2/1974) and the applicable fee regulations of the Madrid Bar Association. 4. Payment Terms
The client shall make payment in accordance with the following schedule, as set forth in this Quotation Estimate:
- 30% advance payment (4,555.65 EUR incl. VAT) upon acceptance of this Quotation Estimate and execution of the retainer agreement (contrato de arrendamiento de servicios profesionales).
- 40% interim payment (6,074.20 EUR incl. VAT) upon filing of the statement of claim before the Madrid court.
- 30% final payment (4,555.65 EUR incl. VAT) upon conclusion of the proceedings or, if applicable, upon the finalisation of the appeal stage before the Audiencia Provincial de Madrid.
All payments shall be made by bank transfer to the firm's account at Banco Santander, ES91 0049 0001 5325 4709 1234, Madrid, Spain. Invoices will be issued in accordance with the Spanish Tax Agency (Agencia Tributaria) regulations.
5. Terms and Conditions of This Quotation Estimate
- This Quotation Estimate is valid for a period of thirty (30) calendar days from the date of issue. After this period, the Lawyer reserves the right to revise the fees based on prevailing market rates in Madrid.
- The estimated costs set out herein are good-faith projections based on the current scope of the matter. Should the complexity of the case increase materially (e.g., additional parties, cross-claims, or procedural complications), the Lawyer shall notify the client in writing and issue a revised Quotation Estimate prior to incurring additional costs exceeding 15% of the original estimate.
- This Quotation Estimate does not constitute a guarantee of outcome. The Lawyer shall act with the diligence and professional competence required under the Spanish Lawyers' Statute and the Code of Professional Conduct of the ICAM.
- All communications, pleadings, and legal documents shall be prepared in Spanish, the official language of the courts in Madrid and the Community of Madrid, in compliance with the Ley de Enjuiciamiento Civil (LEC) and applicable procedural norms.
- The client grants the Lawyer full power of attorney (procuración) to act on their behalf before all courts, administrative bodies, and third parties in Madrid and throughout the Kingdom of Spain as necessary for the resolution of the matter.
- Confidentiality: All information exchanged in connection with this engagement is subject to the attorney-client privilege (secreto profesional) as established in Article 5 of the Estatuto General de la Abogacía and the Spanish Constitution (Article 18).
- This Quotation Estimate is governed by and shall be interpreted in accordance with the laws of Spain. Any dispute arising from this estimate shall be submitted to the competent courts of Madrid, Spain, with express waiver of any other jurisdiction.
- The Lawyer shall comply with all applicable data protection regulations, including the EU General Data Protection Regulation (GDPR) and the Spanish Organic Law 3/2018 (LOPDGDD).
6. Acceptance
By signing below, the client acknowledges receipt of this Quotation Estimate, accepts the proposed scope of legal services, the fee structure, and all terms and conditions set forth herein. The engagement of the Lawyer shall commence upon execution of this document and receipt of the advance payment.
