This Quotation Estimate is prepared for the engagement of a senior Mathematician to support Bayerische Industrieanalytik AG in the development, validation, and optimization of advanced computational models for industrial process control. Terms & Conditions of This Quotation Estimate
1. Validity: This Quotation Estimate is valid for thirty (30) calendar days from the date of issue. After 14 July 2025, rates may be subject to revision based on market conditions in Germany Munich.
2. Payment Terms: Invoicing shall be performed on a monthly basis. Payment is due within fourteen (14) days of invoice receipt (Zahlungsziel: 14 Tage). A 1.5% monthly late-payment interest applies per §288 BGB.
3. Mathematician Availability: The assigned Mathematician is a full-time professional based in Germany Munich. In the event of illness or force majeure, a qualified substitute of equivalent seniority will be provided at no additional cost.
4. Intellectual Property: All mathematical models, algorithms, and documentation produced under this engagement shall become the exclusive property of Bayerische Industrieanalytik AG upon full payment. Apex Mathematical Consulting GmbH retains the right to reference the project in anonymized portfolio materials.
5. Confidentiality: Both parties agree to maintain strict confidentiality regarding all proprietary data, trade secrets, and business strategies shared during the engagement, in accordance with the German Federal Data Protection Act (BDSG) and EU GDPR.
6. Termination: Either party may terminate the engagement with a written notice period of fourteen (14) calendar days. In such a case, all services rendered up to the termination date shall be invoiced in full.
7. Governing Law: This Quotation Estimate and any resulting contract shall be governed by the laws of the Federal Republic of Germany. Jurisdiction for any disputes shall lie with the competent courts in Munich, Germany.
8. Tax Identification: All amounts are stated in Euro (EUR). VAT of 19% is included as per German tax regulations applicable in Munich, Bavaria.
