4.1 Validity: This Quotation Estimate is valid for thirty (30) calendar days from the date of issue. After the expiry date, all rates and conditions are subject to revision based on current market conditions in Germany Berlin and availability of the assigned Meteorologist.
4.2 Payment Terms: Payment shall be made within thirty (30) days of invoice date via bank transfer to the account of Atmospheric Solutions GmbH, IBAN: DE89 3704 0044 0532 0130 00, BIC: COBADEFFXXX. A 20% advance payment is required upon acceptance of this Quotation Estimate to secure the Meteorologist's availability.
4.3 Scope Changes: Any modifications to the scope of meteorological services beyond what is described in this document must be agreed upon in writing. Additional services will be quoted separately and are not included in this estimate.
4.4 Data Protection: All meteorological data collected and processed in compliance with the German Federal Data Protection Act (BDSG) and the EU General Data Protection Regulation (GDPR). The Meteorologist and team shall not disclose client-specific data to third parties without written consent.
4.5 Liability: Atmospheric Solutions GmbH and the assigned Meteorologist shall not be held liable for damages resulting from natural weather events that exceed the forecasted parameters. Meteorological forecasts are probabilistic in nature and do not constitute absolute guarantees of weather conditions in Germany Berlin.
4.6 Governing Law: This Quotation Estimate and any resulting contract shall be governed by the laws of the Federal Republic of Germany. Any disputes shall be resolved by the competent courts in Berlin, Germany.
4.7 Force Majeure: Neither party shall be liable for failure to perform obligations due to events beyond reasonable control, including but not limited to extreme weather events, natural disasters, or government-mandated restrictions affecting operations in Germany Berlin.
