1. Validity: This Quotation Estimate is valid for a period of ninety (90) calendar days from the date of issue. After the expiry date, all rates and service terms are subject to revision by Atmospheric Solutions GmbH.
2. Payment Terms: Invoicing shall be issued at the commencement of the service period. Payment is due within thirty (30) days of invoice date via bank transfer to our account at Commerzbank Frankfurt (IBAN: DE89 3704 0044 0532 0130 00). Late payments shall incur interest at the statutory rate under German commercial law (HGB §288).
3. Service Location: All on-site services referenced in this Quotation Estimate shall be performed at the client's designated premises in Germany Frankfurt or at the offices of Atmospheric Solutions GmbH located in Frankfurt am Main, Hesse, Germany. Travel expenses within the Frankfurt metropolitan area are included; travel beyond a 50 km radius will be billed at the statutory German business travel rate (0.30 EUR/km).
4. Meteorologist Availability: The assigned Meteorologist shall be available during standard business hours (Monday to Friday, 07:00–18:00 CET) for routine services. The 24/7 on-call emergency deployment (Item 6) ensures that a qualified Meteorologist can be dispatched to the Germany Frankfurt site within a maximum response time of four (4) hours during declared severe weather events.
5. Data and Confidentiality: All meteorological data, forecasts, and reports generated under this engagement are the exclusive property of the client. The Meteorologist and all supporting staff are bound by strict confidentiality obligations in accordance with the German Federal Data Protection Act (BDSG) and the EU General Data Protection Regulation (GDPR).
6. Cancellation: The client may cancel this Quotation Estimate engagement with a written notice of fourteen (14) calendar days. In the event of cancellation, all services rendered up to the cancellation date shall be invoiced in full.
7. Governing Law: This Quotation Estimate and any resulting contractual relationship shall be governed by and construed in accordance with the laws of the Federal Republic of Germany. The exclusive court of jurisdiction shall be the Local Court (Amtsgericht) Frankfurt am Main.
8. Insurance and Liability: Atmospheric Solutions GmbH maintains professional liability insurance with a coverage of 5,000,000 EUR.
