All prices are quoted in Euro (EUR) and are subject to the German Value Added Tax (Umsatzsteuer / VAT) at the standard rate of 19 %, in accordance with the German Fiscal Code (Abgabenordnung – AO). If the client is a registered business in another EU member state, the reverse-charge mechanism may apply, in which case no German VAT will be charged on this Quotation Estimate.
- Deposit: 40 % of the total Quotation Estimate amount (€ 2,399.04) is due upon acceptance of this document, payable by bank transfer (SEPA) to the Musician's account at a Berlin-based bank (IBAN: DE89 1005 0000 0000 0000 00).
- Balance: The remaining 60 % (€ 3,598.56) is due within 14 calendar days of the final service delivery date, as stipulated in the German Civil Code (Bürgerliches Gesetzbuch – BGB), § 286.
- Overdue payments: Interest on late payments shall accrue at the statutory rate of 5 percentage points above the European Central Bank (ECB) reference rate, in line with § 288 BGB.
- Cancellation: Cancellation by the client more than 30 days before the event incurs no charge. Cancellation between 30 and 7 days incurs 50 % of the Quotation Estimate. Cancellation within 7 days incurs 100 %.
- This Quotation Estimate is valid for 30 calendar days from the date of issue. After expiry, the Musician reserves the right to revise rates due to market conditions in the Berlin music industry.
- The Musician shall comply with all applicable German labour, tax, and social-security regulations, including contributions to the Künstlersozialkasse (KSK) and adherence to the German Working Hours Act (Arbeitszeitgesetz) for any extended engagements.
- All performances in Berlin, Germany, are subject to local noise regulations (Immissionsschutzgesetz) and venue-specific permits. The client is responsible for obtaining any additional municipal permits from the relevant Bezirksamt (district office) in Berlin.
- Intellectual property: All compositions and arrangements created specifically for the client under this Quotation Estimate shall be transferred to the client upon full payment, in accordance with the German Copyright Act (Urheberrechtsgesetz – UrhG), § 31. The Musician retains moral rights (Urheberpersönlichkeitsrecht) as protected under German law.
- Force majeure: The Musician shall not be liable for delays or cancellations caused by events beyond reasonable control, including but not limited to severe weather affecting Berlin, public transport strikes, or government-mandated restrictions.
- Governing law: This Quotation Estimate and any resulting contract shall be governed by the laws of the Federal Republic of Germany. Exclusive jurisdiction for any disputes shall lie with the competent court in Berlin, Germany (Amtsgericht Berlin-Mitte or Landgericht Berlin, as applicable).
