3.1 Validity: This Quotation Estimate is valid for thirty (30) calendar days from the date of issue. After the expiration date, pricing may be subject to revision based on availability of the Musician ensemble and market conditions in the United States San Francisco performing arts sector.
3.2 Payment Schedule: A non-refundable deposit of 40% ($3,934.21) is due upon acceptance of this Quotation Estimate. The remaining 60% ($5,901.32) shall be paid no later than five (5) business days prior to the event date. All payments are to be made via wire transfer or certified check to Bay Area Artistic Services LLC.
3.3 Cancellation Policy: Cancellations made more than fourteen (14) days before the event will result in forfeiture of the deposit only. Cancellations made within fourteen (14) days of the event date will incur a 75% charge of the total Quotation Estimate amount. Cancellations within 48 hours will result in full payment of the quoted amount.
3.4 Performance Conditions: The Musician ensemble requires a minimum of 90 minutes for setup and sound check prior to the scheduled performance time. The venue must provide a grand piano (or equivalent) unless otherwise specified. In the event of inclement weather affecting the outdoor portion of the Palace of Fine Arts venue in San Francisco, the Musician team will perform in the designated indoor alternative space at no additional charge.
3.5 Intellectual Property: All original arrangements and setlists prepared specifically for this engagement remain the property of the Musician team. The client receives a one-time performance license for the event date only. Recording or broadcasting of the performance requires a separate written agreement.
3.6 Governing Law: This Quotation Estimate and any resulting contract shall be governed by the laws of the State of California, with jurisdiction in the Superior Court of San Francisco County, United States San Francisco.
3.7 Insurance: Bay Area Artistic Services LLC maintains general liability insurance of $2,000,000 per occurrence. The Musician team members are covered under workers' compensation as required by California state law.
