• Validity: This Quotation Estimate is valid for thirty (30) calendar days from the date of issue. After this period, pricing may be subject to revision due to market fluctuations, equipment costs, or scheduling changes.
• Payment Terms: A non-refundable deposit of 40% of the total amount is due upon acceptance of this Quotation Estimate to secure the Photographer's schedule. The remaining 60% balance is due within fourteen (14) days of final image delivery.
• Payment Method: All payments are to be made via bank transfer to the account details provided by Apex Visual Studios, or by EFTPOS for deposits under $500 NZD. Invoices will be issued in accordance with New Zealand Inland Revenue (IRD) requirements.
• Usage Rights: Upon full payment, the client receives a non-exclusive, perpetual licence to use the delivered images for the agreed-upon purpose. The Photographer retains the right to display the work in their professional portfolio and promotional materials unless a separate exclusivity agreement is executed.
• Revisions: One round of minor adjustments (cropping, exposure correction) is included. Additional revision requests beyond the agreed scope will be billed at $85.00 NZD per hour.
• Cancellation Policy: Cancellations made more than fourteen (14) days before the scheduled shoot date will receive a full refund of the deposit. Cancellations within fourteen (14) days will forfeit 50% of the deposit. Cancellations within seventy-two (72) hours will forfeit the full deposit.
• Weather & Force Majeure: For outdoor shoots in New Zealand Wellington, the Photographer reserves the right to reschedule in the event of adverse weather conditions (heavy rain, high winds exceeding 60 km/h, or lightning). Rescheduled sessions will be arranged within seven (7) days at no additional cost.
• Location Permits: The client is responsible for obtaining any necessary filming or photography permits for public locations in Wellington, including but not limited to Wellington City Council permits, NZ Transport Agency (NZTA) road closures, or private property access agreements. The Photographer will provide guidance and documentation support where required.
• Insurance: Apex Visual Studios maintains comprehensive public liability insurance (minimum $20 million NZD) and professional indemnity insurance, compliant with New Zealand regulatory standards. Certificates of insurance are available upon request.
• Governing Law: This Quotation Estimate and any resulting agreement shall be governed by and construed in accordance with the laws of New Zealand. Any disputes shall be resolved through the Disputes Tribunal or the District Court of Wellington.
