The Software Engineer assigned to this engagement holds a Bachelor of Engineering (Software) from the University of Sydney, a minimum of eight (8) years of progressive experience in enterprise software development, and current certifications in AWS Solutions Architect Professional and Certified Kubernetes Administrator (CKA). The engineer is a registered member of Engineers Australia and operates in full compliance with the professional code of conduct for the Australia Sydney engineering community. All work product will be subject to intellectual property provisions consistent with Australian common law and the Copyright Act 1968 (Cth).
Payment for this Quotation Estimate shall be made in accordance with the following milestone-based schedule. Invoices will be issued in AUD and are payable within thirty (30) calendar days of the invoice date, in accordance with the Payment of Skilled Employee Wages Act 1999 (NSW) and general commercial practice in Australia Sydney:

- This Quotation Estimate is valid for thirty (30) days from the date of issue. After this period, pricing for the Software Engineer engagement may be subject to revision based on prevailing market conditions in Australia Sydney.
- All rates quoted are in Australian Dollars (AUD) and include the Software Engineer's professional time, tools, and standard development environment. Travel within the Sydney metropolitan area is included; travel outside Greater Sydney will be billed at cost.
- The Software Engineer will work a standard 38-hour week (Monday to Friday, 9:00 AM to 5:00 PM AEST) unless otherwise agreed in writing. Overtime will be compensated at 1.5 times the standard hourly rate in accordance with the ICT General Award 2020.
- Confidentiality: All information exchanged during the engagement is subject to a mutual Non-Disclosure Agreement (NDA) to be executed prior to commencement. This is particularly important given the sensitive nature of enterprise systems operating in the Australia Sydney financial and government sectors.
- Intellectual Property: Upon full payment, all source code, documentation, and deliverables produced by the Software Engineer shall become the sole property of the client. Apex Digital Solutions Pty Ltd retains the right to reference the project in anonymised case studies.
- Liability: The total liability of Apex Digital Solutions Pty Ltd under this Quotation Estimate shall not exceed the total contract value. Neither party shall be liable for indirect, consequential, or punitive damages.
- Governing Law: This agreement shall be governed by and construed in accordance with the laws of the State of New South Wales, Australia. Any disputes shall be resolved by the courts of Australia Sydney or by arbitration under the rules of the Australian Dispute Resolution Centre.
- Termination: Either party may terminate this engagement with fourteen (14) days written notice. In the event of termination, the client shall pay for all services rendered up to the date of termination.
- Insurance: Apex Digital Solutions Pty Ltd maintains Professional Indemnity Insurance of no less than AUD $10,000,000 and Public Liability Insurance of no less than AUD $20,000,000, as is standard practice for technology service providers in Australia Sydney.
