3.1 Validity: This Quotation Estimate is valid for a period of ninety (90) calendar days from the date of issue. After the expiry date, all rates and terms are subject to revision. The client is advised to confirm acceptance in writing before the validity period ends to secure the proposed Special Education Teacher placement in Germany Berlin.
3.2 Payment Terms: Invoices shall be issued on a monthly basis in arrears. Payment is due within fourteen (14) calendar days of the invoice date via bank transfer to the account specified by EduCare Berlin Special Education GmbH. Late payments shall incur a statutory interest rate of 8% above the European Central Bank base rate, in accordance with German commercial law (HGB §288).
3.3 Cancellation and Termination: Either party may terminate the service agreement with a written notice period of six (6) weeks. In the event of early termination by the client without cause, a cancellation fee of 15% of the remaining contract value shall apply. The Special Education Teacher’s employment and social insurance contributions in Germany Berlin are the sole responsibility of EduCare Berlin Special Education GmbH.
3.4 Confidentiality and Data Protection: All personal data of students, parents, and staff shall be processed in strict compliance with the General Data Protection Regulation (GDPR / DSGVO) and the Berlin State Data Protection Act (BlnDSG). The Special Education Teacher is bound by professional confidentiality (Berufsgeheimnis) under German education law.
3.5 Liability: EduCare Berlin Special Education GmbH shall not be liable for indirect or consequential damages. The total liability under this Quotation Estimate shall not exceed the total contract value of €85,442.00.
3.6 Governing Law: This Quotation Estimate and any resulting contractual relationship shall be governed by the laws of the Federal Republic of Germany. The exclusive place of jurisdiction shall be Berlin, Germany.
Note: This Quotation Estimate does not constitute a binding contract until formally accepted in writing by both parties.
