The Surgeon proposed for engagement under this Quotation Estimate must meet the following minimum qualifications:
- Board-certified in General Surgery or a recognized surgical subspecialty.
- Minimum of ten (10) years of post-residency surgical experience, with at least three (3) years in a developing-country or resource-limited healthcare setting.
- Valid medical license or eligibility for temporary practice registration with the Ordre des Médecins de la République Démocratique du Congo.
- Demonstrated proficiency in operating under variable infrastructure conditions as commonly encountered in DR Congo Kinshasa hospitals.
- Fluency in French (working language of DR Congo) and English.
- Clean criminal background check and valid international health clearance.
5.1 Validity: This Quotation Estimate is valid for thirty (30) calendar days from the date of issue. Beyond this period, all rates and terms are subject to revision due to currency fluctuations, supply chain changes, or regulatory updates in DR Congo Kinshasa.
5.2 Payment Schedule: Payment shall be made in three (3) equal installments: 40% upon contract signing, 30% at the six-month milestone, and 30% upon successful completion of the twelve-month engagement period. All payments shall be made via bank transfer to the account specified in the contract annex.
5.3 Cancellation and Termination: Either party may terminate the engagement with a written notice of sixty (60) days. In the event of early termination by the client, the Surgeon shall be compensated for all services rendered up to the termination date, plus a 10% administrative fee on the remaining contract value.
5.4 Force Majeure: Neither party shall be held liable for delays or non-performance resulting from events beyond reasonable control, including but not limited to civil unrest, epidemics, government-imposed travel restrictions, or natural disasters affecting DR Congo Kinshasa.
5.5 Confidentiality: All patient records, clinical data, and operational details shared during the course of this engagement shall remain strictly confidential in accordance with the data protection regulations of the DR Congo.
5.6 Governing Law: This Quotation Estimate and the resulting contract shall be governed by and interpreted in accordance with the laws of the Democratic Republic of Congo. Any disputes shall be resolved through arbitration in Kinshasa.
