- This Quotation Estimate is valid for thirty (30) calendar days from the date of issue. After this period, pricing may be subject to revision based on market conditions in Colombia Medellín.
- Payment terms: 40% advance upon contract signing, 30% upon completion of the development oversight phase, and 30% upon successful go-live and acceptance sign-off.
- All services will be performed by a qualified Systems Engineer holding a professional degree in Systems Engineering or Computer Science from a recognized Colombian university, with a minimum of ten (10) years of professional experience.
- The Systems Engineer shall comply with all applicable labor regulations of Colombia, including Código Sustantivo del Trabajo and any collective agreements relevant to the technology sector in the Antioquia region.
- Intellectual property rights for all deliverables, documentation, and code produced under this engagement shall transfer to the client upon full payment.
- Confidentiality: The Systems Engineer agrees to maintain strict confidentiality regarding all proprietary information, trade secrets, and business data encountered during the engagement, in accordance with Colombian data protection law.
- Force Majeure: Neither party shall be liable for delays caused by events beyond reasonable control, including but not limited to natural disasters, government-mandated closures, or infrastructure failures affecting the Medellín metropolitan area.
- Dispute resolution: Any disputes arising from this Quotation Estimate or the resulting contract shall be resolved through mediation in the city of Medellín, Antioquia, Colombia, in accordance with Colombian civil procedure law.
- Taxes: All amounts are exclusive of IVA (19% Value Added Tax) applicable in Colombia. The client shall be responsible for any withholding taxes as required by the DIAN (Dirección de Impuestos y Aduanas Nacionales).
